It's always difficult..

It's always difficult to get a warrant when your need for the warrant is based solely on the religion or birth nation of the person.

It's amazing to me that anyone from this nation would say that judicial oversight is to heavy of a burden to deal with and it's just much easier to violate someone's rights. Of course it is, that doesn't make it right and for even making a statement like that he should be fired from his job. Constitutional protections being violated should receive harsh punishments for those involved. We have engaged in hand slapping far too long, and this goes all the way down to the criminal level. It shouldn't be ok for evidence of a crime or guilt to be suppressed because of the actions of government officials or officers, what makes sense is to harshly punish (jail terms) those who violate constitutional rights. This should apply all the way up the chain including the president and congress.

Especially when that judicial oversight is basically a rubber stamp (FISA tends to approve nearly any wiretap request) and can be sought 72 hours AFTER the wiretap begins.

Sigh, the key here isn't that they reject or accept every request.. The key is that SOMEBODY else knows it's going on, somebody CAN check it, and it's on the record.

I'd expect that most, if not nearly all, warrants are granted if things are operating properly. How many warrants are granted versus not is irrelevant. The very fact that someone else outside the agency lays eyes on it makes things 100 times better.

I've had to make classification decisions in work; we have to check with someone else. We almost always agree; doesn't mean we should stop checking though.
