LOL, I've heard all sorts of things, but DSLReports people taking the side of Apple against people unlocking phones they've bought from them? KInda lame.

If I buy an iPhone, I will use it with whatever service I want to use. If AT&T thinks they deserve 2 years of service from me, they had better make it WORTH KEPING FOR 2 years.

That's my beef with cellular providers - they seem to think that they are *entitled* to contracts. They should be forced to EARN their business like everyone else, not like the RIAA who just keeps whining and complaining.

If you signed a contract with AT&T (or Cingular), then you have to abide by the terms of that contract (unless said terms are illegal, etc.) If you unlock your phone and don't pay AT&T, they most certainly have the right to get their "Early Termination Fee" out of you; if you unlock the phone but continue to pay AT&T, I doubt they care.

The cellular providers are entitled to contacts because that is how they make the service available. My understanding is that one can "opt-out" of the contract when one signs up and be on the "pay by the month" plan but it still might have an early termination fee.

Or, put another way, if you don't like contacts, sign up with a provider who doesn't require them.

And if they try to revoke the license? I OWN that copy...and yes, I'm licensed to USE it. But that DVD is mine
In the terms of the license it clearly states that apple can terminate your license if you do not abide by the agreement terms and you are to destroy any copies of apple software under that license.

People should be able to use them however they want but Apple should be able to refuse to repair or replace phones that have been modified or are not being used on at&t's network.

If you're paying the ETF, Apple should still be getting the money - IMHO "you voided the warranty"! Is such a lame clause, what if the mod had nothing to do with the reason for the warranty repair? What if the LCD died? Grr.

Unfortunately the warranty covers the phone as a whole so even if your mod has nothing to do with what is broken, since you've altered the phone then the warranty no longer covers it.

No....you agree to a EULA...but it says NOTHING about me hacking or destroying it....you agree not to redistribute it...
Same as an album...I can't make money from their work or redistribute but free to do with it as I please....burn the CD, rip it etc...
Doctrine of first sale. You are free to sell anything you own that has been legally obtained. Software & music included. Of course any backup copies should be destroyed when you no longer possess a license and should never be distributed, even with the original work.

Here in the US that is known as illegal. You can do whatever you want. Apple does not provide an unlocking service at no cost, so as long as your unlocking did not damage the phone the warranty is still in full force. Also just using it with another network would not void the warranty either.

Guess why there's no iPhone in Europe? Phone locking is illegal except for Germany & France (.. if my memory serves me correctly...) the countries where it's rumored their might be a release).

Yeah, but if you unlock it, is it still the software to which they can revoke your liscense?

And how exactly will they do that anyway? The hell if anyone will let them touch their phone, and I highly doubt that kind of thing will hold up. It's one thing with a piece of purchased software (and I'm not even happy about that (or sure it'll hold up)), but it's another with a device so integrated with its software software.

That's like someone saying, you used a TiVo, so now you're not allowed to watch your TV at all. You can't even turn it on anymore.

We will see how long it lasts. I bet Apple is already working on SW update to lock the phones again as they should.
NO ONE is patching the ROM in the iPhones already out walking the streets in Joe Blows' hands. They can fix the next generation of iPhones perhaps.

I'm not a lawyer, but I doubt if Apple could legally revoke the license to use the software to run the iPhone, because without it, the device you bought would be inoperable.

Falls along the lines of destruction of property or something like that.

Well, by using the iPhone you are agreeing to the terms of the iPhone agreement and in it they state that they can revoke your use of the iPhone software.

Yeah, but agreements say all kinds of things that never actually stand up in court. The only way they could keep you from using the modded iPhone is if they took it away from you.

If Apple wants *TOTAL* control of they hardware they shouldn't even be selling it to you, they should be renting it out as part of the service.

I could care about all the legal mumbo jumbo. As a T-Mobile subscriber and wanter of the iPhone, I think this is an idea whose time was overdue! I love the iPhone but just freed myself from Cingular last year, so no way was I going back. Soon as I see people are doing this successfully, one will be mine!

Agreed, that and myself I would be happy enough with the iPhone sans internet.

(I'm a tmobile sub and see no reason to pay more than $30 a month for phone service!)
