 1 edit | Whether it says "unlimited" or not doesn't matter. They made an agreement with the entire public when they made commercials, press statements, and ads. It can be easily researched that they had defended their network on occasion by telling people how "stable" it is, and how it - supposedly as opposed to DSL maintains it's speeds as promised, no matter the situation. When you break your advertised word, it's called defrauding the public, because your advertised word is a contract WITH the public just as well as a TOS is a contract with an individual. Also, if you tell the public one thing through advertising, then change the rules with a TOS after they have signed up - that's the equivalent of "bait and switch" - which is illegal. If you tell me I will get a fish and you send me a cat - you cannot defend yourself - you broke the contract.
the question can also be posed - is Comcast preying upon the public perception that their access will be "unlimited"? Do they disclose that it will NOT BE unlimited in the TOS, or in their advertisements??? Who is responsible for informing the customer of thier rights - or lack there of? If it ISN'T there, and the public has been led to believe that "unlimited" is what they would be getting - then it stands to make sense that it cannot be blamed on the user - and the company has breeched it's contract by placing restrictions on them.
In my case - I paid for extra for 8mps+, and my agreement was that my LIMIT was 6mbps. It doesn't say "in spurts" or only "between 3am-6am". I was explicitly guaranteed at least 6mps (the lower plan has no guarantee - but says "up to 6mbps"). Since it states at least 6mbps, it stands to reason that at any time if it falls below - or is "capped" that I can say that my contract has been breeched. I can't speak for the people who aren't paying for the extra speed - as it does say "UP TO" which could mean 0kbps - 6mbps... so why do I need to have the word "Unlimited" in a TOS? Whether it's there or not, Comcast has already committed itself because they cannot provide the service they promised me if my speeds drop below 6mbps! |

You make a statement that you want "some other company" to "give these 'bitches' some [edit] competition" so that you can get a little relief. First, let me state that most places have plenty of options. There is DSL, FiOS, dial-up, satellite broadband, T1, etc. Now I know there are restrictions for the first 2 items, and it sucks that the telco's can't get their acts together, but don't blame the big bad cable companies for their shortfalls.
When did it come to pass that every man, woman, and child has an absolute right to the internet? While I agree that companies should do everything they can to at least give as many people as they can the option to get the service, I don't agree that this burden should fall squarely on cable companies shoulders. Telcos seem to have free reign in cherry picking their customers and no one says a thing about it. Imagine if Comcast decided to resort to taking out half of their nodes, using an IP pool, and restricting access to those that are over 18,000 cable ft from their CO? Telcos that provide DSL currently do this, yet I see no one talking about it. Yes, it is a restriction to the technology, SO FIX IT! 
Yes, I know I wasted a lot of breath here, because this site is 100% anti-cable. It shows in every news article thats posted. After all, it originated as "dslreports."
