BT is a very robust protocol that can survive many disruptions and even corrupt data, producing a perfect copy of a file. It can resume without redownloading more than a few KB, at most. Can you even say that about ftp or any other protocol. I think you need to crack the books to find the real issue here, which is weaknesses in the TCP/IP stack, especially in Windows, It is what is vulnerable to these false messages and no protocol can do anything about it as it runs at a higher level than system protocols and services. You could kill any protocol in manners like this and that is just what these crappy ISPs are doing, Limiting is one thing, but when it becomes impractical even for casual users, well that's quite another. Try Linux and iptables on 2 ends(seeder and leecher) blocking the flags for these bad packets on both ends and see what happens. iptables runs at kernel level for the non *nix inclined. I think you will be surprised.
