So...how does the MPAA propose the ISPs should break encrypted links? Encrypted P2P might be vulnerable, but there are other 'sources' that are probably being used that aren't P2P. I know that one major 'discussion group' provider has SSL. And they aren't the only one. You can encrypt your link all you want, but you can't hide WHERE the data is coming from.
