| Phil Spector murder case declared a Mistrial

said by CNN--> »www.cnn.com/2007/US/law/09/26/sp···dex.html : The jury deliberated for 12 days, taking six ballots, but was unable to reach a unanimous verdict.
Jurors told Superior Court Judge Larry Paul Fidler they were split 10-2, without indicating which way they were leaning (which later was revealed to be 10 for guilty & 2 not guilty). They added there was nothing Fidler could do to help them arrive at a unanimous verdict.
Apparently, the prosecution will retry the case pretty quickly.
I think these "downtown urban" jurors are biologically dumb, and fell for the defenses lies when they played the "senior-citizen card". These jurors were making a statement that even though Spector "brutally murdered" this Beautiful Blond Woman, they were going to "stick it to the man"...payback. They probably were jealous of her blue eyes.
This is "the worse day America has ever seen". Our "justice system is in shambles". Spector is a scum bag who "thinks he can get away with anything." I have been watching Fox News all day and they said he was "guilty as sin", so I know it must be true.
If the next trial ends up the same, I am going to spend the next 12 years of my life bringing up this travesty of justice every chance I get. Because you just can't trust these geriatric types, "they are all violent predators".
Hopefully, her family members file civil suit against him in Santa Monica or Simi Valley, where we know the jurors are decent folk. |

| Cutler was involved with this case, so I wouldn't be the least bit surprised if he brought some of his Gotti defense bags of tricks with him and managed to get to a couple of the jurors.

i think they'd get manslaughter in a second. i don't think this guy needs a long sentence to be kept from doing this again. what really needs to happen is the criminal case to end so the civil one can go forward.
of course, the 2 hold backs were arguing something like there wasn't enough blood on him for him to be close enough to have been holding the gun, which means they wouldn't have voted for manslaughter either, they thought he was innocent.

From what I recall of last night's TV news, two of the jurors felt that there was a reasonable doubt, i.e. felt that there was an outside chance that maybe Clarkson had committed suicide.
I'm pretty sure of what happened: Spector is well known for brandishing his gun at women, even sticking the gun in their mouthes as testified to by witnesses. I think Spector has a combination of senility, egotism, drunkenness and probably drug use too, and power trips over women (and he has probably had many during his legendary career). I think he has a habit of getting liquored and drugged up and threatening women, trying to dominate them and scare them into his bed.
I bet this time he was inebriated as usual and up to his old tricks sticking guns in women's mouthes, and he tried it on Clarkson, and he was so f---ed up that he unintentionally pulled the trigger, or maybe she bumped his hand while she was trying to get away from him. By the time he realized what had happened Clarkson was dead.
He got the best possible attorneys combined with an ambiguity of physical evidence, a lack of witnesses, and possibly they prosecuted him for the wrong crime. I think they should have prosecuted this as manslaughter. I think they will retry the case as manslaughter, or as murder with manslaughter as an alternate verdict. I think they will obtain a conviction in that case (at least manslaughter), and he might even go to prison although I doubt it will be a long term (a few or several years).
The big thing that was missing from this trial is malice. I understand Spector and Clarkson met only that night, he picked her up at a bar (where she worked?). It's hard to imagine a murderous malice building up in that limited time. It's easy to imagine this old guy all drunk and doped and waving a gun around, and accidentally killing her. I think that would be a slam dunk of a verdict! |

| reply to dogma One of the points that was not STRESSED by the prosecution which i think was very telling: Phil is frequently called a genius - obviously that pertains to music only. What kind of an idiot would even touch the gun that was used by someone to shoot themselves with - much less wipe the gun clean of fingerprints..?? In fact Phil felt that action was more important than picking up the phone and dialing 911 - it is the act of a guilty man. |
