Notice of Lease Termination/Non-Renewal from Apartment???

Friends,we relocated to DFW in May 2002 due to corporate restructuring and had 30 days notice to do it.

With the short amount of time we had there was no time to go home searching as we were on the left coast and not local so we chose to lease an apartment in Far North Richardson which is nearby my wife's employment.
We have leased this apartment for over 5 years with not one complaint against us from other community neighbors and placed maybe a dozen or so maintenance requests in that time.

Last week we received an out of the blue certified mail 60 Days notice of Lease Termination/Non-Renewal which we approached the Director last Friday for a reason why and she could not provide an answer as the community has been here since 2001 so it's not being leveled for a shopping center or sold from what I gather.

We're all sorta family here as all the staff has watched our two sons 6 & 7 grow up since we moved in,we're really really disappointed for the ownership/management proudly displays a photo of our family on their Website as an example of the friendly/family like community this is and it's one of the nicest I've seen honestly.
We're just dumbfounded why they want to uproot our kids from the place they've happily called "Home" for over 5 years not to mention will be forced to change schools mid year due to this community is the only apartments within their school zone.

Is there anything we could do to force them to rescind this notice or convince them to rescind? I've called the TAA in Austin which forwarded me to a tenants counseling service in Dallas which has a meeting once a week on Weds evenings.
We're deeply saddened and disappointed as to the no reason why we're being thrown out as there's tenants that have been here longer than us without a single issue which have been happy with their occupancy.

I never told anyone this but I'm permanently disabled from a motor vehicle accident that occurred in 2001 which keeps me on a fixed income.

Sorry for the long ramblings friends but we're looking for avenues to head off this termination at least till May/June 2008 as school year ends and my wife purchases our home then(finally).
I appreciate your feedback,recommendations,suggestions & comments.

My sister was in the apartment industry for 12 years. Let me see what I can find out for you. She's out of town, so I might not be able to get back to you until later tonight.

Is your lease a standard TAA lease?

Yes we had/have a standard 12 month lease renewing for the last 5 years. Any help is greatly appreciated as we just can't afford to move till May 08.

I'm also considering contacting the various TV stations & Newspapers with our case on Monday as I'm not sure how many other upstanding citizens have been done over like this.

I'll do what it takes to keep my kids roots planted till early summer when we do get into our home.

You don't boot good tenants from your rentals, it's just not done.
This "Director" has no reason, no one higher up to ask?
There has to be a reason!

I currently own a home, but am looking to ditch it and begin renting sometime in the next ten years or so, and do not plan on owning again. Your position certainly concerns me with my future plans.

I have never renewed a lease on an apartment; I was one of those wandering souls, before I built a home.

so, pardon my ignorance but....
Isn't the whole idea of the lease term expiring so that either the leaser or the lessee can get out of the deal with no repercussions?

I certainly understand your position and hope that when I get rid of my home I find a place to rent and would like to stay there for years and years and years.

A lessor can certainly choose not to renew a lease; however, they need to have a legitimate reason to do so. Think about it. Most of these management companies are managing these properties so that the owners could make money. Why in the world would you suddenly decide to kick someone out that is paying rent on time (and helping the owner achieve their financial goals?)? Doesn't make sense. I would consult an attorney.

Legally, boh the property owner and the tenant can choose not to renew the lease for any or no reason. You might be able to embarrass them into renewing for another term by going to the media, but you should be prepared to leave at the end of that new term.

If you are unsuccessful in getting a renewal, you might be able to keep the kids in their current schools for the rest of the school year, so long as you stay in the district. You might call the district offices and ask.

IF you are permanently disabled I would definitely throw that out at them. It sounds very much like discrimination to me and I am sure a few attorneys out there would think so also.
You do have rights, stand up for them and find out why they are doing this. Good luck.

I agree that something smells fishy here. They are a for profit company so why would they get rid of a paying tenant and have to spend at least $1000 on new carpet and paint and risking the apartment being vacant for a month or two ...or more? Is it the nazi flag on your patio? I'd play the discrimination card and try to get the real answer so then you at least you know what your up against. Do you get subsidized rent and maybe they are tired of working the system to collect?
I might be able to find someone who can help you for free with representation. I'll send an email. There's a guy that I help out who is on section 8 and he is heavily handicapped from a gun shot to the head. He was evicted late last year and this attorney had that reversed. I'll try and find out who that guy was and privately email you his contact info.
