[Need] help removing unwanted exe file

My Father has downloaded a file called BearShareV6(2) its an .exe file and is on his desktop. I have looked to uninstall it and remove the file but every time I try to get rid of it it wont allow me to delete it, it says in use I have gone through all the processes and cannot find it there to terminate the process. It doesn't seem to be doing any harm but it's up to no good I just know it's nasty. Can someone advise me how to get ride of it. Tried safe mode too, still wont delete, and its not in add remove programs either. Avast doesn't see it as a virus either.

OS: XP home.

Why does this happen??? I had a similar problem once with an .avi file. It wasn't till I ran Spybot that I was able to delete it.

It is always malware???

No ,it may be just part of the program [a driver,service,dll] that didn't close properly!

Usually caused by programs that are written poorly!

Or make it even easier. Boot into Safe mode (tap F8 while booting) and you can delete it from the desktop. Then reboot without F8 to get back to normal windows.
