1 edit | I'm not a lawyer but I think that if you call up immediately and say you do not agree to the new terms, you can indeed break your contract. A contract as they say is a meeting of the minds. By continuing to use the service, they assume you de facto agree to the changes. I imagine if you call and complain pretty soon after the changes occur, and you express your dissatisfaction, you'd have the right to walk away from your contract, or so is my guess. |

| reply to jc100 I'm not a lawyer either but you did not agree to the terms they changed to which gives you full right to leave; they are the ones who breached the terms to favor their self (which is always the way it goes) but since you signed a contract that said "unlimited" they have to offer you that or give you the option to leave without penalty. Which means no $200 for early termination charges. |

 | reply to duked IANAL, however, most cell contracts have a provision on how this is handled. Generally, simply by paying your next bill after the TOS change (which is generally there, somewhere, in the fine print on the bill)... You agree to the change.
So, you'd have to call VZW before paying your next bill to break the contract. |

 | reply to hottboiinnc Im not a lawyer too but I agree to both of you guys and plus I think verizon should owe $175 dollars to anybody who disagree to their revise TOS. First of all when I sign a contract I didn't sign for that. So whenever I cancel because they change their policy they should indeed pay me $175 for changing their minds. Like they do to us whenever we change our mind and cancel their service |

 | Unfortunately, it doesn't work that way since they are still offering the service. Plus, they got lots of big lawyers and they figure no one's going to sue for that. I imagine if one day someone class actioned over it, we might see a different result. Still, whenever a company changes something, you usually have the right to opt out without penalty. If you stick around, its assumed you don't have objections. Hence, you wave your right to complain down the road. Therefore, call immediately if you aren't happy with a change!! |

 | reply to duked You should read the tos and contract good. Some time they will have a paragraph stating that they can sell transfer or change the tos with out notice. -- Caddy |
