Unless they have irrefutable proof, such as a recording, it is his word against the CSR who was probably retaliating against the man. He goes free and ISP/CSR is fined and pays attorney fees. Plus compensates the man for slandering him.
Oh yeah, and for those of you who judge the man based on his mug shot, ears, etc., sure hope you are never called up for jury duty. Of course unless I happen to be the plaintiff and not the defendant.

I'm fairly certain most CSR interactions are voice recorded...least, that's what the pre-emptive recording tells me.

| Just about every place I call now has the recording that this call may be recorded or monitored, etc.
Also given all the shootings (Virginia Tech, etc.), it is not a stretch to react as the company did concerning a threat to bomb. Our "Me" generation does not have a lot of anger management tools, witness the road rage incidents. In fact today, I got the finger from the car behind me be cause I was driving the speed limit. | |
