by those terms and conditions, if you apply them equally to /all/ the P2P variety of applications, it would also disallow you from hosting a private teamspeak server for you and your friends, hosting a private FPS server to play with your friends, connecting to your friend's computer directly via AIM to send him a file, among many, many, many other day to day activities that even the "average joe" user does on their computer.

also, even beyond that, the main reason most users don't want to file lawsuits against their ISPs is not because "they won't win"...it's because they cannot afford to. to whomever it was who suggested "filing a class action lawsuit" against an offending ISP, are you aware of just how much that would cost? moreover, the fact that we would have to FILE that lawsuit is made of what most serious internet users would call "epic f***ing fail", because isn't part of the oversight that these ISPs are supposed to be recieving from the government intended to make sure they actually provide the services that they are stating that they are indeed providing?
If the ISP is actually not providing the service advertised, the people to actually talk to would be the better buisness bureau, not immediately go and file a class action lawsuit, because, for the most part, the private citizens who are screaming "foul!" about the problems they are having with their ISPs cannot afford the tens of THOUSANDS of dollars it would cost to even attempt to go to court about it, much less the years that the major ISP legal teams wouldj spend tying up the case in courts.

not that i know anything at all about the US legal system, or anything.
