Never said the system is perfect. Problem there is liberals like Nancy Plasticosi pandering for votes from the illegal aliens.

They say right on the site they they don't take responsibility for what is tracked there.
And fences(aka pawn shops) claim they aren't responsible for reselling stolen goods. But they go to prison nonetheless when they get caught.

I think that "PIRATE Bay" being the biggest torrent tracker says a lot about the bogus claims that bittorrent use isn't primarily used for pirating(coyright infringement) music and videos.
Your logic is completely flawed. Right now the biggest gang in Austin is Mexican. But that doesn't mean all mexicans are gang members.

Pirate Bay may be the biggest tracker, but even if you allow for every single torrent they have being pirated material (and some of it is not), that still just makes them just the biggest pirate site. It says nothing about BitTorrent as a protocol being "primarily used for pirating"

that's because they benefit from and have possession of said goods.

piratebay just provides a pointer to something. holding piratebay responsible for someone else infringing is like arresting the innocent pedestrian for bank robbery because he gave directions to the bank.

Infringement is here to stay. You can't put the genie back in to bottle. Learn to live with it.
It's not theft, there is nothing LOST when someone makes a copy. There is only GAIN. (Granted, the GAIN isn't profit for the megacorps, but the real people of the world, GAIN from infringement, that's why it's so popular)

Surely you aren't implying that tracker owners don't benefit from distribution of copyrighted works...even if the works aren't directly stored on, or transmitted through, their servers. How is TPB doing so well if there's no benefit?

You mean like the writers and performers of the copyrighted works? A world where content isn't paid for, will lead to a world where very few are motivated to produce and distribute content. Great for short term people that are too cheap, but long term, we're all going to suffer. It'll impact much more than the corporations that you despise so much.

The writers and producers already get zilch. Didn't you hear about the writers strike. These useless incompetent fat cats are the looters of the world. They work by means of collusion. They have never produced anything of value themselves. They squabble with the producers over pennies. Your argument is moot. Greed is wonderful, but those that try to profit on the backs of others (without exchanging equal value for that labor) are the worst kind of scum.

Myspace and bitorrent will soon see the day that the artists are free to profit and exercise their greed on a fair and level playing field, with those consumers who are willing to trade their hard earned dollars for something they see as of equal value. Right now artists make most of their money from live performances. Movie studios may see a market correction in actors salaries etc... when they start to realize that hundreds of millions is not what it takes to make a movie. Others like George Lucas will still survive and make hundred million dollar movies because they do not answer to a middle man and are good businessmen.

i like the idea of making music and movies more reasonably priced, but how are the singers and actors (or should i say brats high on themselves) going to feel when they realize they can't afford a third ferrari, third multi-million dollar house, or that their acting/singing is crap and isn't worth ~$20/cd or +$8/movie_ticket? you know they have feelings too.

such life and there is not much you can you about it for the most part. with the riaa/mpaa/actors/singers holding pretty much all the money and power, they can buy off government with ease and higher a fleer of lobbyists if they so choose.

And thats what bit torrent was originally designed to combat.

Too bad everyone hates it so much, or you could have whatever file that is already.

Qtrax site up and running; but check warnings at end of msg

said by TKJunkMail See Profile :

said by stltech See Profile :

shame that Qtrax is down right now!
They claim back up in 24 hours.
Please check back in 24 hours to download the first, free, and legal P2P music application.
I guess when it hit the newswires their servers offering up the new software downloads got buried.
Looks like they got the site up and running again:

They have a message that their software download will be available at Midnight EST.

Of course, legal though it may be, it is P2P based, and depending on how they implemented it, it may be throttled by Comcast or other ISPs if their software tends to flood upstream bandwidth.

They say their software is developed off a Gnutella based platform: »www.qtrax.com/legal.php
QTRAX/QTRAXMAX is a free, Gnutella-based file sharing software allowing users around the world to make peer-to-peer connections with each other.
But be careful what you share:
We have no control over the information and data being disseminated or contained on any Gnutella network. You are ultimately responsible for the material you choose to upload, download and share with others. You will be personally liable for downloading and/or sharing infringing materials or copyrighted works.

We are, however, conscious of the legal issues involving sharing of certain types of files and ultimately these issues will be decided by the Courts or an Act of Parliament/Congress.

In the mean time, however, we expect all users of QTRAX/QTRAXMAX to comply with applicable laws, to respect the moral and legal rights of copyright authors and owners, and to use the Gnutella network in a responsible and law abiding way. While ideas are not fully protectable (only the expression of ideas), users who do share their own ideas with others expect others not to steal their protected works. THEREFORE, DO NOT STEAL FILE TYPES WHICH YOU DO NOT HAVE A LAWFUL RIGHT TO OWN OR USE.
So, it looks like their software could be used to trade music and other files NOT on their list of licensed music. Getting you in trouble with the RIAA or others who may come sniffing around thru your shared folders.

They may not have all their LEGALITIES lined up as they said:

Yeah, and maybe if the government gave more handouts then criminals wouldn't rob liquor stores. Must be the government's fault.
lol, aren't people getting $600 each from your Fed gov?
Look, those Fed checks are usually only for the rich ones who does not need it - a.k.a. tax breaks - and this time these checks got a lot smaller and go for almost everybody...

Yep, but that's because we're overtaxed. They are giving us back some of OUR money that they stole from us. Without interest, I might add. All tax cuts and refunds are an ackowledgement that the gubmint has taken too much of what WE earned.
Utter BS - US is one of the lowest taxing countries in the Western world.

It's nothing but a stupid, primitive attempt to fool people to think BUsh is actually doing something - it's a preposterous idea and has nothing to do with any kind of economic 'jumpstart'.

When the service works with WMP, Call me!

the reason the piracy model works is because theres no bullshit with DRM, low encode rates or any of the other crap these paysites have. THEY STILL DONT GET IT!

Go back and read my first post. I never said anything about Bush doing anything. 600 bucks won't make me or break me. It will buy some beer and sushi. What I DID say is Plasticosi wanted the refunds to go to those who did not pay into the system. She is among those trying to buy votes for herself and her party.

But the fact still remains, any and all money coming back to we the people is simple overtaxation. We are owed more. Far more.
