Maybe I didn't explain myself well. There has been a lapse of time of 6 years. McNamee had this evidence in his personal possession for that 6 years. Over that time span he could have done anything to those items. He could have even tainted them himself. Now if he has knowingly suppressed evidence from an illegal activity I would assume he could now face charges. I would think him having this evidence at the time of the investigation with federal officers present and not turning it over would guarantee him prosecution. Remember he told the whole truth and held nothing back. -- anonymous |

| Yes, but investigators can evaluate the evidence themselves and come to conclusions about whether it's been tampered with, whether it's admissable evidence or not. It won't automatically be thrown out, or automatically be accepted (if it exists at all, which we don't know yet). He said McNamee had injected Clemens at Clemenss apartment in New York; Clemens was then a Yankee and McNamee was on the teams staff. McNamee then took the syringes and pads to his home in Queens, where he had a medical waste-disposal box.
But McNamee, a former police officer, decided to save the evidence rather than discard it, the lawyer said. He was always concerned that if he ever got caught, he would be the most vulnerable and people would throw him under the bus, the lawyer said.
McNamee did not tell federal investigators about the syringes and pads when he first met with them in 2007. And he never discussed such evidence with investigators for former Senator George J. Mitchell as Mitchell was compiling his report on the use of performance-enhancing drugs in baseball.
The lawyer said McNamee kept quiet about the physical evidence out of lingering loyalty to Clemens, the winner of seven Cy Young awards, even though McNamee, by then, had created tremendous problems for Clemens. He had done so by telling federal authorities and Mitchells investigators that he repeatedly injected Clemens with steroids and H.G.H. from 1998 to 2001.
Theres no question it raises issues, a second lawyer familiar with McNamees situation said of McNamees initial reluctance to cite the physical evidence. But at the same time, the issue is what the evidence says. If the evidence says what we think it does, then its all over.
