Interesting... Quite gross that he held onto bloody syringes and gauze pads. What was he planning to do with them? Sell them on e-bay? Wait until Roger was elected to hall to defame him then?

Clemens' route looks to be jail rather than the hall of fame...

Unfortunately for McNamee none of that evidence should be allowed. It was not collected properly by authorities and will be deemed tainted. Good Luck next time Brian.

I think you're wrong. Using that argument, there's no admissible physical evidence except what was collected by the police (or investigators).

Maybe I didn't explain myself well. There has been a lapse of time of 6 years. McNamee had this evidence in his personal possession for that 6 years. Over that time span he could have done anything to those items. He could have even tainted them himself. Now if he has knowingly suppressed evidence from an illegal activity I would assume he could now face charges. I would think him having this evidence at the time of the investigation with federal officers present and not turning it over would guarantee him prosecution.
Remember he told the whole truth and held nothing back.

Yes, but investigators can evaluate the evidence themselves and come to conclusions about whether it's been tampered with, whether it's admissable evidence or not. It won't automatically be thrown out, or automatically be accepted (if it exists at all, which we don't know yet). This is a "wait and see" situation, not a "whatever McNamee has is already worthless" situation in my opinion.

I will agree with you on that.

I do think if he has anything at all it could very well damage him criminally because of the federal investigators and not turning it over then.

Unless he can prove, to the satisfaction of the court, that the "evidence" was never out of his immediate possession during all that time, and nobody else had any access to it, and it is Clemens' beyond any doubt, I think he has an uphill battle ahead of him, provided this is a criminal investigation.

If it comes out that Roger is indeed dirty then I would put my money on what hangs him will be the testimony given by Andy Pettitte.

Good point, I can't wait to see what Pettitte mentioned in his deposition.

I agree with that. But IF it's really what he says it is, chances are great that he kept it in a safe and private place, and didn't take it to parties to impress friends, you know?

As long as he can prove it, because he will have to.
But I agree that there will be far more weight given to testimony, if there is credible stuff, like Pettite. That's almost like an unbiased third party type of thing.

quote:
Federal criminal authorities have sent the gauze pads, syringes and vials for testing by a laboratory. If they show evidence of blood, the authorities may consider asking Clemens for a DNA sample.

If members of the committee ultimately conclude that Clemens did not tell the truth in his deposition and make the same conclusion about the statements he makes at a committee hearing set for next Wednesday, Clemens could face charges of lying to federal officials, which is punishable by up to five years in prison.

The lawyer who disclosed the existence of the syringes, vials and pads insisted on anonymity because he was not authorized to discuss the case. He said McNamee had injected Clemens at Clemens’s apartment in New York; Clemens was then a Yankee and McNamee was on the team’s staff. McNamee then took the syringes and pads to his home in Queens, where he had a medical waste-disposal box.

But McNamee, a former police officer, decided to save the evidence rather than discard it, the lawyer said. “He was always concerned that if he ever got caught, he would be the most vulnerable and people would throw him under the bus,” the lawyer said.

McNamee did not tell federal investigators about the syringes and pads when he first met with them in 2007. And he never discussed such evidence with investigators for former Senator George J. Mitchell as Mitchell was compiling his report on the use of performance-enhancing drugs in baseball.

The lawyer said McNamee kept quiet about the physical evidence out of lingering loyalty to Clemens, the winner of seven Cy Young awards, even though McNamee, by then, had created tremendous problems for Clemens. He had done so by telling federal authorities and Mitchell’s investigators that he repeatedly injected Clemens with steroids and H.G.H. from 1998 to 2001.

“There’s no question it raises issues,” a second lawyer familiar with McNamee’s situation said of McNamee’s initial reluctance to cite the physical evidence. “But at the same time, the issue is what the evidence says. If the evidence says what we think it does, then it’s all over.”

Ut oh. If that's true, then he knows how to preserve evidence and what's required for the "chain".

Methinks Roger is sweating profusely, right about now.

Roger met with Congress again today at Rogers request.

McNamee and Roger in the same building together, hope they don't cross paths.....

If Clemens turns out to be dirty then I will have lost what little respect I had left of the game.
