Dear Insight Broadband Customer,

Insight monitors network usage to ensure that all Insightbb.com customers consistently receive the highest quality service available, as detailed in our Acceptable Use Policy. You may not be aware that your modem has been transferring data at a very high rate for an extended period, causing degradation of service to others. Now that you know, we request your cooperation. Excessive sustained bandwidth usage places a burden on the network and is in violation of the Insightbb.com Acceptable Use Policy (see sections vii and viii. ) which explains that you may not:

vii. restrict, inhibit or otherwise interfere with the ability of any other person, regardless of intent, purpose or knowledge, to use or enjoy the Service, including, without limitation, posting or transmitting any information or software which contains a worm, virus or other harmful feature, or generating levels of traffic sufficient to impede others' ability to send or retrieve information;

viii. restrict, inhibit, interfere with or otherwise disrupt or cause a performance degradation or manipulation, regardless of intent, purpose or knowledge, to the Service or any Insight (or Insight supplier) host, server, backbone network, node or service, or otherwise cause a performance degradation or manipulation to any Insight (or Insight supplier) facilities used to deliver the Service.

We have found most excessive bandwidth users are running servers, using Newsgroups or using online file sharing programs such as KaZaa, BitTorrent and others. We feel it our responsibility to alert you to the dangers of online file sharing applications and offer suggestions as to what can be done to protect yourself as well as reduce the amount of bandwidth being used by your account. For instance:

There are a number of viruses designed specifically to spread through peer-to-peer networks. Your best defense is to keep your anti-virus software updated. If a file you download seems smaller in size than expected, you should avoid running it. Many of the viruses that exist at the moment will rename themselves to mimic popular programs, music, or videos in hopes that the victim will open it.
Most of the file sharing applications contain "spyware" that is used by affiliates and marketing companies. Besides being an invasion of your privacy, many End User License Agreements (EULAs) grant these companies the power to use your extra bandwidth, processor cycles, memory, and drive space as they see fit.

In response to this, I typed this up but have not sent it yet...

Dear Insight Broadband Company,

I pay my Insight bill, I do recall it having a charge for Internet Services on that bill.
I also recall when I ordered the service it was restricted to 10Mbits/sec down and 1Mbit/sec up. and I am staying below that restriction (as I have no choice).
I also recall being told that my Internet service is UNLIMITED and ALWAYS AVAILABLE to me to be used whenever and however I feel.
I do NOT recall being told that you would be "monitoring" my usage and invading my privacy and thus you are hereby asked to cease and desist invading my privacy.

While I can see your point in feeling like you should be able to download to what they offer in any amount. Theres two things from this .. one just maybe just maybe your a parent and your kids are doing this without your knowing. Just maybe you could have a virus or something as if you were unfamiliar with things and this was your notice that something is up. Theres alot of maybes .. how are they to know who and what is in your house and how well you know things.

I also a fairly big internet user HOWEVER i dont want the right to be able to download with limits and things lost. So theres a common sense thing, if you push things to the limit and everyone else does it theres going to be rules that will EFFECT ALL OF US. Then where does it get you? Instead.. try taking that as a note that well maybe I need to "lessen" what im doing. If your not doing much then something else is wrong, and they DO HAVE THE RIGHT to monitor the network. I hate to tell you the bad news but whomever you go to its the same way. You want unlimited and the works buy a T1 or go business.

I MAYBE download 100 gigs a month, might be about equal on the upload, and have slightly heavily used 2-line VOIP, so you're saying I am using my account too much and should buy a business line ?

right there is probably your reason uploads are the cause of most letters ive seen people get (unless your doing HUGE HUGE amounts on downloads) My suggestion is cut it about 50% .. otherwise your going to need to go into a business account for your home/apartment.

Its real simple its basically the same but as your going to hate to hear its going to cost more and youll get less speed. Last I heard the 6mb pack I think was like $90.

Just call them and ask »www.insightbusiness.com/sm_data_services.php the reps are cool .. ask about download and uploads limits and which packages.

The Viop is on a different line of bandwidth, and not factored in with the computer use. The upload is what is "monitored" Heavy upload is usually equated with file sharing and virus/spyware issues, and clogs up the servers. Also, when you do sign up for service, you agree to go by the policies of the service.

Xanmi , that is not entirely true. If he has the Insight phone service through the modem then yes it is routed differently, but if he is using 3rd party voip service such as Packet 8 or Vontage then no it will utilize his upstream and downstream via his cable modem.

I have vontage and I download alot also. I have been doing this on insightbb for years and have never received a letter about it (knock on wood). VOIP shouldn't use that data and my phone is literally in use at least 20hrs/day.

Please don't be offended by this, but are you using limewire or some torrent program? Maybe that would be your problem. Cut back on sharing and see what happens. If you don't use a program similar to that, then I don't know why you have problems. Even if you have a WOW gold farm in your basement, it shouldn't use that much bandwidth.

he has to also consider over populated nodes in his area, if he is using wireless does he have it secured so the next door folks are not getting a free ride.

remember that while you are allowed up to 10Mbit per sec down and up to 1 Mbit per sec upload there are too many factors that can play at hand. Also please keep in mind i said Up To speeds... no where is there any promise you will get or maintain those speeds constantly.

with voip for instance on vontage and most 3rd party services they utilize your upstream @ a normal rate of 60kbits per sec for a decent quality or 90 plus kbits per sec for a excellent qaulity. with that in mind you now have to times that by 2 for an average of 120kbit to 180kbit per sec if you where using both lines at once.
now granted that does not mean that its is a full continuous upstream usage all the time, but it still takes away.

now add in what you average on bittorent services and if your seeding (sharing files on the upload side) you could be capping yourself out quite easily.

there is alot more to this and if i had more time since it is late now that i am posting this i would explain.

i know insight's network pretty well since i worked for Insight for over 3 yrs and Insight Business for over 2 years.

Well, i got the letter. I didn't bother to read most posts, but basically it was explained to me that they dont look at what you are downloading, just the bandwidth you're using. I assume that you're using usenet, and with that in mind will assume that you can throttle your bandwidth. Try that. Worked for me. Just keep in mind the "up to" and that it's burst, not constant.

I actually don't know how to use usenet and Insight doesn't have any kind of bursting technology that I know of.

I hog the pipes and I never received the letter. Maybe if a node you are on isn't over used Insight doesn't care how much a person uploads and downloads.

I have to say, you know with all the talk and Rogers in canada going to limited pay packages. You guys who are using consumer accounts to break well over 100gigs in downloads a month is whats putting these packages into place. Then yall get upset when you get notices. Making adding more fuel to the fire as to why these ISP's are making limited pay packages. Not only are you making it to where you guys pay more but us people who use half that (which is still a good amount) being forced to pay more.

I for one dont want limits nor want to have to pay more. I have NOT done anything cause 5 or 10 percent choose to abuse it. If you all want to do such big amounts then get a business account or something but stop taking this as us regular consumers who DONT abuse things.

I dont care to hear your I have rights its unlimited crap, or Ill just go to some other company or companies will just loose everyone with rules like that. Im just like you are and I DONT WANT LIMITS TOO. Wake up and just get business or something so you wont have to deal with letters and all that. Yes your going to pay more but then you have ALOT more room.

You crack me up. You really think that you are entitled to 7 GIGABYTES of bandwidth a day for $40 a month? Well, clearly you do.

If your online activities were strictly legal I would say that you have a beef, but I would bet everything that I have, and everything that I will ever have that you are involved in some heavy copyright infringement. Bittorrents, P2P or Usenet right? It doesn't matter to you though. You'll stand on your little soap box and loudly proclaim your right to steal music or movies or tv shows or software as fast and as much as you please.

Paying $140 is spit in the bucket. When I signed up there was no mention of "unlimited" usage and "always on" doesn't mean "always on and always pegged at the max" continuous connection.

I also have 20 service and cable. However its like going to the store to buy stuff. Theres limits on what you can buy. If you want to buy 100 of lets say milk gallons you buy it business sizes. Is that fare for you to walk into the store and see someone go in and buy all the milk up in one shot. Then there be none for you, let alone none for anyone else to buy.

Yes your free to rein on what you do but theres also common sense and control. Im against limits like Rogers or satellite has and with people like you guys who abuse it .. theres going to be limits. Then what! You screw yourself and others.

As far as downloading music and movies, I don't do that on my Insight account. It's far safer to war drive and borrow an unprotected hotspot.

I got a letter also , a week AFTER I upgraded.

I am a network engineer by trade. In Korea I paid about $10 a month in Korean currency for a 10 mb connection up and and a 100 mb connection down.

The amount of money the ISP's make on bandwith here in the States is pretty sick.

I maintain several sites in several states with everything from T connections to DSL to you name it. I purchase bandwidth from all the major providers for business.

I have a friend who runs an ISP and I have seen what he pays for his bandwidth to include his loop back fees.

What most ISPs are doing is promising greater speed but then sending out letters hoping to scare their customers into not using it. Heaven forbid they should have to use the money you give them to increase their pipes to the last mile.

Those here who squeal "Just use less or the ISPs will go to a pay by byte plan". I ask you what makes you think they are not already going there. Why do you think they are sending the letters?

America has been had by the ISPs and their pet Congressmen and Senators. Who here has watched the Oversight meeting on CSPAN for the last 3 years. Most network engineers have, I have.

America is the laughing stock of the IT world for how the home users are treated and bent over for what they pay vs what they get.

Compare pricing for bandwidth to the home for any country vs America.

And now the ISPs are Pavlovian conditioning the users not to use what they sell. How hard would it be to say what the caps per month are? Answer - Very hard because many customers would quit when they were told they are capped and go somewhere where they are not. Thus the "secret" caps that you can exceed without knowing and get a letter for.

You used 24GB in 2 days. That is excessive in my opinion. I would not want you in my neighborhood sucking up all of that bandwidth. There is no cap. There is monitoring for excessive use. You didn't get cut off or charged for excessive use. You got warned.

Thank you Insight for telling this "expert" to tone it down. I appreciate it.
