Every time your cable modem connects to Comcast, it downloads what is called a config file. This config file specifies a bunch of info but for your specific question it contains the caps (max speeds) for your upload and download. That is primarily how it is done.

I wonder if I can expect them to play games in order to get me to buy. I'm happy with my speeds already.

That would be illegal I think. Purposely degrading your performance in hopes you upgrade to a higher tier? No, they shouldn't do that.
