Hm, good point- FiOS works the same as cable, but U-Verse is true IPTV and I suppose should be considered a data service (no matter how much one hates "the new" at&t)

Is the determination made by the intention of the service (tv, phone, etc) or the medium it is delivered by (IP, COAX, Fiber)?

Well, if you're declaring VoIP, which is intended to provide phone-type service, to be not phone, then it seems like a precedent is set to exclude IPTV from cable regulation... though cable regulation and phone regulation are two very different animals.
