Rocky, if there is a proceeding of some kind, if available as a remedy you should seek an injunction to prevent Bell from throttling Teksavvy pending resolution of the issue. |

I don't want to pry, but could you give any indication on whether the contracts ISPs sign with Bell are mere implementatiobns of the published tariffs with legalese surrounding them and terms such as contract cancellation issues, or is are there additional clauses above and beyond 5410 (that would discuss "Fair Use" for instance.)
In the type of meetinsg you had today, do ISPs drop trousers and compare their Bell contract to see if they all have roughly the same items ?
If the contracts Bell makes you sign have clauses that go against the spirit of the tariffs, this definitely has some traction with CRTC AND industry Canada.
Knowing whether the contracts go beyond the tariffs or whether Bell is just interpreting the Tariffs the way it wants would influence individual's structure of any involvement with Industry Canada and/or CRTC. |
