[Help] Questions on Legalities

I woke up this AM to find this note in my inbox on deviantart from a friend who is a photographer in Canada. I am not that well versed in Canadian Copyright, and can someone tel me if it pretty much is the same as ours? (USA) I have told her already to retain a lawyer asap, and if any of you could offer anymore advice, I would appreciate it. Thanks, John

I did a portfolio for a lady here..and I use that term loosley..and she got the disks from me and now won't pay me...and she is going to put them on a web site although she says she isnt but I asked for the disk back due to the fact that I own the copy rights..to the images..since she has not paid me...she says I took the pictures for fun...63 of them...yeah right...anyway..this is saturday...I have asked for the disks back..and I know damn well they are at the place where she is getting her website built..I am going to find out..where..not to many here..hehehehe..and then have the isp take down the pics as they are still my copyrights...she dosn't really seem to belive me that I own the copyrights..I am really upset....she claims that she wont use them..but I have a feeling she is going to try...without paying form them..any suggestions/

confused in Dryden...
oh and I have been threatned that if I do something folks in Dryden will make sure I dont do photography anymore...

I am not a lawyer, nor a canadian.

I see two issues here,

1. Theft. Not paying for the physical disk(c?) seems like it would be theft of a physical object. Also, the content of that disk has value and also may constitute theft. This will probably all be lumped into one valuation of the disk, so you can say it wasn't a $0.20 CD but rather a $50.00 compilation (or whatever the agreed-upon price was).

2. Copyright violation. This doesn't appear to have happened yet if the pictures aren't yet online, but be watchful for if they do appear.

I had that happen really early and yeah it was my fault. So it was a hard lesson learned thankfully not that costly. Since then all models sign a release and never get a disc of RAW unedited images. Good luck and hope everything works out!
