This is key. The opt-in/opt-out is a red-herring distraction. Phorm products will have to operate on an opt in basis to use traffic data as part of the process of returning relevant targeted marketing to internet users.
The statement appears open to interpretation by lawyers.

Will Phorm still be able to collect the data whether you opt-in or not? Or is the opt-in merely on the ad display to the end user?
