Re: speed factory seems to be no more....

I'm a ex employee also. And I can say that its all about money, and the writing has been on the wall for a long time.

As ciscokidccna stated. The merger changed everything and the local atl techs tried to maintain but its hard with no resources from the powers that be. At this point the people who kept everything together are all GONE. That's right, all the major techs are gone. So B____ no need to call anybody out, no one will be contacting you for assistance. Hopefully, everyone is in a better position and good luck on all future endeavors.

I also want to say that I really believed in SF and loved what we stood for when I first joined a long time ago and we were still a small company. I'm sorry that service declined and so many problems arose. Good luck to all the (ex)customers that believed in us to begin with. All good things must end. So good luck with your new internet choices.

"Offiicial" cached Google notification of Speedfactory Closing

It looks like the "parent company" website www.npwireless.com is also down as well.....

When I did a lookup on Google for "speedfactory closed" it pulled up a cached version of the official closing report for SpeedFactory. Since the npwireless page was down I had to pull up the text only cached version....

See you later SpeedFactory compadres...

Here it is - Google it yourself if you don't believe me:

"NextPhase Closes SpeedFactory Acquisition"

Company Expects $2 Million Increase in Annual Revenues as It Further Expands Portfolio and Reach With Acquisition of Leading Regional Business-Class ISP

ANAHEIM, CA -- April 12, 2006 -- NextPhase Wireless (OTCBB: NXPW - News), a next-generation connectivity company that specializes in integrated Internet, voice and data communication solutions, today announced that it has closed the acquisition of Atlanta-based SpeedFactory announced in a release dated March 29th, 2006.

As stated in an 8-K filing on April 11, 2006, SpeedFactory, Inc., a wholly owned subsidiary of NextPhase Wireless, Inc., acquired all of Synkronus, Inc.'s assets, excluding cash, pursuant to an Asset Purchase Agreement dated March 29, 2006 between SpeedFactory and Synkronus. The assets acquired by SpeedFactory comprise Synkronus' Internet service and connectivity business operated by Synkronus under the name "SpeedFactory." SpeedFactory paid $1,500,000 in cash for the assets at closing and did not assume any pre-closing liabilities from Synkronus.
CUSTOMER BASE GROWS BY 1100%

"SpeedFactory is a highly respected ISP, providing business-class DSL services to customers in Atlanta and the fast growing South-East region since 1998," said Robert Ford, NextPhase's President and CEO. "Together, we now provide a broad range of connectivity services to over 2500 customers in two of the fastest-growing regions of the country; Southern California and the South-East," added Ford.
REVENUE RUN RATE INCREASES TO $3.5M

Not only will the acquisition immediately add to our revenue and cash flow per share, it further strengthens our market-leading portfolio of connectivity products and services, and extends our geographic reach," said Ford. "With the contribution of the SpeedFactory acquisition starting in the first quarter of fiscal year 2007, we're now profitable and expect to see positive operating cash flow and much improved margins once the full integration is completed," added Ford.
COMPREHENSIVE PORTFOLIO OF CONNECTIVITY SOLUTIONS

In recent weeks, NextPhase has added Business-Class Digital Subscriber Line (DSL) services to its broad portfolio of connectivity solutions; announced the nationwide wireless 'last mile' capabilities of NextNode Virtual Networks™; signed a Letter of Intent with Onasi, Inc. (OnSat) to form a joint venture to provide integrated connectivity solutions, using satellite backhaul and wireless 'last mile' technologies, to rural US markets and developing markets internationally; signed an agreement with Communication Technology Services (CTS) for the nationwide provision of broadband connectivity installation and technical support services.

"This acquisition, together with our other recent announcements shows that we're committed to building a world-class, full-service connectivity company. Through our broad range of products and services, we now have the ability to deliver flexible, scalable, reliable and cost-effective connectivity solutions to business customers anywhere in North America, and to developing markets outside the US. Whether customers are located in established metropolitan areas, developing regions where growth is outpacing the infrastructure build-out or in rural communities, we're now able to deliver solutions that can adapt and evolve to their changing customer needs," added Ford.

Re: "Offiicial" cached Google notification of Speedfactory Closi

Only because I am sitting in the office rather than at home while waiting on data loading to production...

Normally would not do this ..

The use of the word closed taken in context below indicates completion of a purchase in 2006
I would have used "Acquisition" rather then purchase but did not want to confuse…

Just jumped to ATNEX. I went a visited the office as well and saw the signs. I've been an SF customer for a long time and I hate to see what happened. NP ran it into the ground. I certainly wish I had seen this coming, but it's not something you think about.

I just switched to Atnex as well. I'm just glad that I can still stick with a local ISP for a reasonable price. SF was good while they lasted. Unlike a lot of folks, in the years that I've used them, I could probably count the outages that had any real impact on me on one hand. Shame about the presumed poor financial situation...

The problem for me is I am under contract and if they aren't closed and will be back up and I go with someone else I am out a ton of cash...guess I have to wait. The real bummer is I am reading this while on vacation. The last vacation I took, my bank Netbank went under. Guess I should never go on vacation.

Ha ha ha... you are kidding? I was a netbank guy also.

This is a double whammy for me also, LOL.

With respect to the contract, how are you out of money? Did you pay a bunch of money upfront or buy some hardware or something? If you bought hardware and it was Cisco, just e-Bay it, you'll get a decent price.

I would suspect by now that SF would be in default on any contract that they have made with their customers. With an outage this long and no communications from them other than what we've heard in the group I suspect your contract is worthless and can not be upheld.

I just switch to AtNext(sp?) and I talked to the rep about the situation. He said they have been very busy switching customers over. The minute he hangs up the phone he gets another. It took 5 minutes to do the transaction. Hopefully it will take 5 minutes to do the switch over. I confirmed with him that all I need to do is change login info in my Linux router and reboot. Hopefully I'll be in great shape.

Our office also has SF. Luckily I moved all critical servers to edeltacom two years ago. We've decided to take the office to AT&T. We've learned about us keeping the same provider...

Would someone please post the mailing address of Speed Factory. I need to send them a letter canceling my internet....signed up with Atnex today. Since their site is down, I google'd for an address and got the Shallowford Road address, but with no suite number....I thought there was a suite number.

It's pretty damn ridiculous that I (along with others) had to go to Broadband Reports to find out what the hell is going on over at Speed Factory -- so rude and unprofessional. I've been with them since 2003.

I signed a one year contract that has like $175 early disconnect fee plus all the monthly fees up until the contract is out.

AtlGeek

reply to staijo
Any contract can be challenged and declared unenforceable under a basis of misrepresentation or failure to deliver.

If I was in a contract with SF, I would just switch and stop paying, and refuse to pay, and if they do charges to the CC, just file chargebacks with the reason being failure to deliver service and tell your bank the charges are not authorized.

I'm not sure the legality of it, but it's not likely they will take you to court over any amount less than $10k because the legal fees will cost them that much, and their situation is pretty much indefensible.

A case can actually be made that SF is failing to live up to it's end of the bargain, and should they come back online, they may actually face from issues related to customer lost revenue and failing to live up to their side of agreements.

In short - as long as you are a hard ass, I definitely wouldn't worry about any contract at this point ... this is a 34 hour outage as of right now with no substantial communication from the company.

Speedfactory --- Where are you? Anybody out there?

Well, we're running into the second day of outage with Speedfactory and their parent company, NextPhase Wireless. And no announcement from the companies.

The recap is that when calling any numbers that are given for either company, one receives the reply that "all circuits are busy,' with the exception of selecting "1" to get sales when calling Nextphase (you receive a recording to leave a message for the sales person).

There are no postings o the Internet or service announcements on the phone from either company.

I can ping speedfactory's DNS servers and get their webpage that's on them (their sales splash pages).

I know there are a lot of imposters out there who will post under an assumed name, so can you do something that we can see that is from you? Like posting a page and a phone message with an explanation and an ETA for restoring service if there is one? Your courtesy would be appreciated and your silence is very bad for business.

Regards,
Moishe

Regarding contracts:

1) Yes, people get sued all the time for less than $10k. There's a whole "small claims" court system for that . What frequently happens is that the "debt" gets sold to a debt collection agency who calls you and harasses you. You stand up for your rights and they sell it to another hapless collector. Eventually, you get sued by someone who figured out how to use Mail Merge to fill out lawsuit forms. You stand up for yourself again and they dismiss the case, but it's on public record that you got sued. My case was for only $835 on a credit card I never applied for (identity theft). In retrospect, it would have been worth my $835 to just pay it, but that would be missing the point ($8,000 in legal fees later, I won the case and started appearing as a witness for other people in my "batch" of bad debt.)

2) They have bigger problems than suing us right now They need money to do that.

3) As I see it, they disconnected me. They're the ones in violation of the contract. They should just take the black eye of cancellations and be happy that we're not talking about a class action lawsuit against them.

4) Instead of a class action suit, what will probably happen is that everyone will complain to their bank and request a "charge back" of the fees charged. Speed Factory will get a stack of complaints and their bank will probably suspend their processing account, thus cutting off cashflow. In addition to taking your monthly fee back, Visa/Mastercard will fine them something like $35 per transaction. If they charge you again, just do another charge back and they'll get another fine. Of course, with no cash to pay people to respond to the charge back complaints, they'll loose by default.

That's the way I see it shaking out.

My line is already being provisioned for a new provider, so I don't see how Speed Factory will be providing service if they ever come back up. We just passed our 2nd "8pm," so I'm not sure which one they were talking about.

I can't think of any ISPs that have gone down 48 hours and survived. Can anyone else?

WOW! ATNEX called me back!!! As stated this might be a miracle on a saturday, I ordered service at 8:am today and got provisioned around 6:pm..

Configed router with PPOE info and had DNS issues, called ATNEX problem was on my end with windows holding old DNS info from SF. Whats sad is I am a Tech..I should done that!

Thumbs all the way ATNEX.

Just a word to the wise, these guys signed a ton of SF refugees like us today. They told me they signed up today what they do in 6 months. So provisioning is on Bellsouth/att. Just be patient with them.

AWSOME JOB ATNEX! you earned my business and recomedation to others.

Obviously this post is from my new ATNEX line.

Well, I also drove by the office as I'm only 5 minutes from them. I can confirm the hand-written note on the glass door telling people to call their CA office (with the same circuits busy message).

However, one thing I did see on the door on the OUTSIDE was a note from someone from Net2Atlanta stating that they would be glad to buy all of SF's assets. I find that pretty sleezy from Net2Atlanta. Not even waiting for the body to be cold yet.

I (like most everyone here) have switched to AtNex and hope to be up by Monday.

Hi all.

This morning I filed out the contact form at »www.net2atlanta.com/ to switch from Speed Factory, after waiting far too long hoping they'd come back online.

About 5 minutes after I hit submit, Milt from Net2Atlanta called me. We worked through all my needs, and he submitted a change order into whoever it is that controls those things.

Throughout the day, Milt called me several times to advise me of the progress, and was able to get the Powers That Be to push up my switch over from Monday to today.

So, I've gone from being a dead in the water Speed Factory customer to a brand new customer of Net2Atlanta, and I'm thrilled to say I'm back online less than 12 hours after I called them to sign up.

Obviously, I've only been using their service for about 10 minutes, but their customer service has been awesome, and I can't say enough good things about them.
