Apple and at&t do require that you become a customer- people who unlock their phones and use them on other networks have to bypass the phone's security to do so, and Apple software updates tend to make unlocked phones unusable... but that doesn't stop people from doing it.

I'm wondering why they don't simply refuse to sell phones to people who don't have/or refuse to get contracts.

Is it some sort of in boarding to require a contract when selling a device?

Seems like unlocking would just about be a moot point if AT&T required you to have a contract before they let you buy the phone.
