That's pretty much a standard type statement by any voip, isp, cellular, etc... Basically saying that if there are any problems that you work it out with them and not in court.
Not in my experience. What is standard is saying that disputes should be resolved by binding arbitration, but saying that "we make all the decisions and determinations in disputes" is a bit different than that (not to mention probably not legally enforceable).
