finally, the immunity part of the bill has other constitutional issues, not the least of which is that making it retroactive is against the takings clause. additionally, many of the laws the telco's are running afoul of are state privacy laws, outside federal preemption (currently). separation of powers (state and federal, as well as the 3-way federal) is taken seriously by the constitution, and the current SCOTUS makeup is heavily federalist (strong states rights).
finally, discovery is an very useful tool in any litigation, and "reasonable cause" is your made up term and, unsurprisingly, make no sense with respect to the current discussion. |

congress, however, could consider it a high crime and impeach, but that's not going to happen before december. |
