I especially can't believe the Bell arrogance in their statement...

"In Bell Canada's view, there was no evidence to support CAIP's arguments that there were difficulties in managing service to end-customers or that reductions of traffic volumes delivered to Internet backbone providers were causing CAIP's members to pay for capacity that they could not actually use. Bell Canada submitted that even if there was financial harm resulting from delivery of reduced traffic volumes, the harm would not be irreparable because CAIP's members were obligated to pay for contracted transit capacity and GAS whether interim relief was granted or not.

That's like saying "Although we're squeezing your nuts in a vise, you're still contractually obligated to sing Basso profundo".

The only power we people have now is in our wallets. Dump Bell phone, dump Simpatico(sic), dump ExpressVu, dump Mobility!

The Commission considers that CAIP did not provide sufficient evidence in support of its claim that its members no longer need the amount of transit capacity and GAS service components that they have contracted for, and that they will suffer irreparable harm if interim relief is not granted. Similarly, the Commission considers that CAIP did not provide sufficient evidence in support of its claim that Bell Canada's throttling practices will make it difficult or impossible for CAIP's members to properly manage the services that they provide to their end-customers and that these practices will result in permanent loss of market share or goodwill. Finally, with respect to CAIP's claim regarding loss of revenue due to customers terminating service, the Commission considers that CAIP failed to demonstrate that its members will suffer irreparable harm as a result of Bell Canada's throttling practices. In conclusion, the Commission finds that CAIP has not demonstrated that its members will suffer irreparable harm if the interim relief was not granted.
Such bullsh*t.. Bell does not have to justify why they are throttling but the CIAP has to justify why throttling harms them? I don't understand why the CIAP has to prove anything when Bell is the ones using its monopoly on phone lines to do whatever it wants. So TSI now has to sell its service with a disclaimer that states due to Bell Canada your service will always be affected (degraded) from the hours of 6pm* - 2am*. How is that not harming TSI? Do they want testimonials from every CIAP customer effected? What about customers who aren't aware of the throttling effects and just chalk it up to something else.

That is what is wrong with this whole situation. The CRTC should be asking Bell to provide evidence on why it is necessary to throttle its entire network. They should also ask Bell to back up its "5% users 95% usage" with hard evidence.

Its a sad day when you can tell that the CRTC sided with the big corporation so it doesn't piss them off.

The response seems to be all about the "Irreparable harm" from the RJR case history.

Without every member opening its books for full scrutiny by Bell Canada and amongst their own competitors there's no way to provide proof of harm or irreparable harm, which itself could cause irreparable harm!

In a perverse way this may in fact be the way NOT to produce irreparable harm to the CAIP members ... now anyone who considered leaving Bell is far more likely to, to support the CAIP members.

Everyone is throttled.

And go where? Pretty much all CDN internet options are throttled. At least with TSI you get 200GB. I think this decision will only fuel further throttling circumvention methods, in addition to further soiling Bell's reputation with customers.

we lieterally just got herded like sheep into a slaughtering house....mr roger pushes from one side. mr bell pushes from another.. forming 2 sides of a triangle.. so the sheep try to run out the only remaining face .. then bell just decides to block off the entrance for the other farmers becuase they seem to be where the sheep are going!

Actually the CRTC did NOT state that there was harm being done, but rather that for the issuance of a cease and desist order there was no proof of irreparable harm. It still leaves the door open for a longer term considered approach.

There's Look's microwave inet... 3web's cable (if u can deal with the crappy CSR's), and rogers if you don't encrypt anything, their thottle isn't too bad.. just the cap is. There's also some wireless options available.. Primus and some other companies who run their own dslams also may get more business out of this.
