said by basquiat :Ah, TK misses the point again. See in Sweden, as in Canada, downloading music is not illegal, possibly unethical but not illegal. On top of that the Pirate Bay has zero content on its servers. Basically it provides links (like Google) and no real content. Check out » thepiratebay.org/legal for some amusing links to previous (failed) hollow legal threats. He usually does. |

1 edit | reply to TKJunkMail Sure, then Google/Yahoo also are next in line, you say? If so, rock on..... BTW, this has happened to TPB so many times, it's old news to us TPB fans. All I can say is YAWN!!!!! The MAFIAA can go fsck themselves, or rather, sodomize themselves with ' self-retracting batons' as TPB sez. Now, in the other news today..... The sky is blue, and water is wet!!! Fascinating! Have a good night... |

They are law abiding in the sense that they break hundreds of laws trying to prosecute someone else whose laws that they want to apply to them do not and they are angry at that.
TK Junk believes every damn law in the USA applies to ALL countries and his blind support towards the RIAA(probably hired by them to post here) make him a nice troll. He never provides supports for questions that are raised towards him. Instead he responds with another question, deviates from the topic, and/or ignores the post. |

| reply to TKJunkMail Just because some people choose to break the law does not mean corporations can strangle my rights to do what is legal for me. Guns are used to commit crimes, as are cars, should both/either be made illegal because some people use them to commit crimes?
And actually, I was a little to conservative in my original claim; it appears any download of copyrighted material for personal use is not illegal in Canada...yet.
"Sharing copyrighted works on peer-to-peer networks is legal in Canada, a federal judge ruled on Wednesday, handing the record industry a sharp setback in its international fight against file swappers." [»www.news.com/2100-1027_3-5182641···=st_pop]
"Canadian courts have ruled that consumers have the right to copy any recording from the original copy even those they do not personally own. This consumer right has been extended by the courts to include peer-to-peer downloads." [»en.wikipedia.org/wiki/Canadian_c···ght_law]
"Copyright violation is NOT a crime, unless in the pursuit of profit. It is and always has been a civil matter at the end user level. Of course, if you press 1000 DVD's with the motive to sell the work, that is in fact a crime. ... Simply read the FBI warning on ANY DVD word by word and you'll note the subtle distinction, as they cannot call it a criminal offense, and do not, because simple filesharing and personal violation of copyright is not a crime." [»www.edu-cyberpg.com/Music/musiclaw4.html]
Of course, the CRIA (Canada's version of the RIAA) is fighting hard to change the laws, and oddly the ones fighting against the CRIA... the musicians: "But the Canadian Music Creators Coalition, whose members include Sarah McLachlan, Sam Roberts and Avril Lavigne, has said it would not like to see a law that would lead to lawsuits against music fans." [»www.cbc.ca/arts/music/story/2007···aw.html] -- In theory there is no difference between theory and practice, but in practice there is. |

It is the same as being a fence for stolen goods. The legal term is criminal facilitation.
And here is a new wrinkle which just came down from the Supreme Court today. And that is FREE SPEECH does not extend to invitations to illegal transations(read that copyright infringement). While this was aimed at child pornography, the SC decision puts limits on all speech inviting illegal actions. »news.yahoo.com/s/afp/20080519/pl···nography

| reply to TKJunkMail Perhaps they are crooks but in this case the people going after them are very bigger crooks in my book. These media companies are collecting huge sums of money by forcing people to by content they couldn't sell in a free market but can force people to pay for to get the stuff they want.
If Hollywood ever decided carried out their business in an ethical manner I might feel sorry for them but they don't so I hope TPB and others like them bleed the scum for every penny they can. |

And you truly think that people are downloading copies of music they already own and not copies of music they don't own? Don't make me laugh. Yes! I know technically challenged people who find it easier to download their songs opposed to ripping their cd's in respect to bullshit drm and putting it on a mix cd for auto or onto a mp3 player. A troll has nothing to do with personal attacks, that's just called being a jerk. A troll is someone who makes off topic or controversial comments with the intention of gaining attention or causing conflict.
I have noticed that you never justify your opinions on copyright infringement, and that is likely the reason he (and many others) feel you are simply trolling. Perhaps you could explain why you feel copyright infringement is no different from stealing a physical object. And if you are unable to explain it, perhaps you should reconsider your opinion as being wrong. |

For folks that are curious about why artists might be unhappy, here's a "Howstuffworks" article explaining how royalties are allocated.
»entertainment.howstuffworks.com/···ies7.htm
The RIAA has nothing to do with this process, fortunately, nor do they receive any of the proceeds from the lawsuits. They all go to the folks that are actually suing, the record companies. Of course, they are paying RIAA to prosecute the suits.
One hopes that the lawsuit mentioned in the eugenegill article goes forward because t might make public exactly how much has been taken in by the suits and where it went. |
