Lets take this to it's simplest form.

1. Did the user know that their download directory was shared by default.

most people who download software dont even read the eula or anything else for that matter.. its click click click.. hurry up and install already.

Billy bob the dumb redneck may have downloaded a song.. without realizing that it WAS available for them to be downloaded.

so is billy bob guilty of an action he was unaware of?
