So you're basing your 3 assumptions on a fact you are mistaken about.
Stating Sprint obviously sees no problem with capping a service when they've been the only uncapped EVDO service is simply a logical fallacy. They are instituting the cap to prevent a data usage nightmare. They just started offering the Unlimited $99 dollar plan, which includes EVDO data. |

And perhaps you should read the AUP yourself. It outright talks about throttling. Perhaps I should quote it since you havn't read it.
