Remember this is not full DOCSIS 3 yet. They have the download done correctly but there hasn't been anything certified in uploads yet so they're still using the old DOCSIS 2 upload. By offering 5 for upload, they're actually stretching their bandwidth even farther. They're giving you more even though they still don't have more yet.
