Yes, I know identity theft is real and you'd be more sensitive to it if you had it done to you once, but honestly the chance of having someone skim your card has got to be pretty damn low.
Well as one that HAS had their identity stolen you bet i'm not letting that card out of sight, I always pay with cash at restaurants.

I talked to the waiter and the manager. The card is on my moms account and so she also called and complained a lot to the manager also. The waiter said that it must have fallen out but he could not find it. I was kind of suspicious with how long it took him to come back when my friend and I gave him the cards to pay. He did not even come back to the table for at least 5-10 minutes.
Probably all the help grabbing their own personal swipes of your card.
Or perhaps realising the card is gone, sweated his ass off looking for the card everywhere.

So, you did not realize that OG or Darden Restaurants have gone in the pisser lately. Pretty much every establishment that you go to, to purchase food that is a Corporate entity has poor service.

If it wasn't ran yet, I hope you told them that was the only form of payment they you had. And if it was charged, I hoped you did not sign the check since they returned the slip without your card.

Unfortunately, it was already ran. After we gave him the cards he took about 5-10 minutes to come back to the table. He brought back the folders with the receipts to write the tip on and walked away. My friends had his card in it but mine did not. I had to call him back to the table and he acted surprised about it. I of course left no tip for him, and I did not sign them either.

If it had been my choice I would not have chosen it, but it was my friends birthday, so I let him choose and that is what he picked. There were 3 of us there and 2 checks.

I am never responsible for charges that I don't make so I can care less if my card leaves the room. Cards that do hold the consumer liable for those charges should be cut up and trashed......

I was thinking that may be it, but if it is what pisses me off is he did not mention it when he came back to the table. He left the folder and walked off. When I brought it up he acted like he knew nothing about it missing. If he knew it was missing he should have said something when he came back.

While you are not responsible for charges you haven't made, you are most certainly responsible for accounting for any unauthorized charges that appear on your card statement.

And doing so involves time and paperwork. You have to both list the charges and sign an affadavit declaring that those particular charges were not made by you. And that being the case, wouldn't it be easier (not to mention smarter) to keep an eye on your credit card in the first place?

Unfortunately, you do end up being held liable for unauthorized credit card charges, albeit indirectly through higher fees and interest rates.

I hope no one is under the impression that credit card companies simply choose to suck up those charges and not pass them on to their customers. Because you'd better believe they do.

Honestly, I consider Pizza Hut to be more of an Italian restaurant than the Olive Garden ever will be. That's how sad it is. I ate at one the first time I moved to Dallas from San Francisco, and I've been scarred for life! If you have a choice, in my opinion, always head for the "mom and pop" cafes. They may not have corporate budgeting, but the food is more than worth it.

It must vary from region to region, because the 3 different Olive Gardens I've eaten at have had excellent service & food consistently.

Funny you mention this. The last time I went to Olive Garden in Austin my card was charged an extra $10. We left a nice cash tip on the table and the waiter added the extra money after we left. I ended up calling the manager and he didn’t seem surprised. I always save my receipts so when I took it to OG for the manager to photocopy, he gave me a free lunch or gift card. The situation sucked but the manager handled it very well.

Must have been lucky the manager handled it like that or it was the "corporate" training that helped. I went to a recently opened "mom and pop" restaurant here in Atlanta a few years ago and like you I paid the meal on my card and the tip in cash. Also like you I found the transaction on the card was higher than what it should be, about 18% worth or the amount of a fairly average tip. I discovered it that night when I checked my balance online (paid with a debit card actually) and immediately went back up there.

Now to clarify the waiter knew about the cash tip before the card was swiped so it wasn't an honest mistake. Do you know what the manager told me? He told me that banks see it comes from a restaurant and automatically add in 18% for the tip amount. I promptly spit out the word "bullshit". The manager basically said that by the time it actually posts (I took up a print out of the bank statement and the slip) it would be the correct amount. He wasn't very helpful at all but the next time I went there I noticed the waiter was no longer there. The restaurant has changed hands a few times since then so who knows if the manager was really the one behind it to help pad his bottom line.
