I understand that you think your clickdata belongs to you, but it's not a copyright and neither you nor anyone else will be able to use that argument. Clickdata is a privacy issue, not one for the copyright office.
It's %100 unique and created by me, what else would you call something you can copyright?

No one seems to care about privacy online these days, but every time you turn around some huge group is crying about their copyrights being violated, so I figured maybe I'd join them.

Beautiful fantasy you've got going on there, but no court in the country is going to assign you a copyright for clickstream data because it is not considered a fixed medium.

You'd have to go pretty far up in the food chain to get a judge to render a decision that makes it so, and, somehow, I don't ever see that happening.

Yea that's the most likely outcome. Kinda sucks in a way, but hey.

The thing that's rather annoying is that the ISP seems to think they own the data, so someone CAN claim ownership. Just a question of what stands up.

I still say the more annoying part is that they could be or are modifying web site code on its way back to the requestor and it is that part I think is highly objectionable.
