Re: Sprint Refusing to waive Early Termination Fees

For the record: If the stipulated date of 21 Aug. holds up, then my data card connection with Sprint is on its last legs. After that it's a matter of what shows up on my next bill + becoming a millenicommunicator. Update: The data card has disappeared from my account. The Mogul is there now all by its lonesome. Progress!

I just was able to cancel mine about 2 days ago. After getting into a fight with 3 different online REP's and about 3 over the phone it finally happened. And of course i confirmed it. You just have to call back 50 million times.

To answer your question about how long MCom takes to get you up and running, I can tell you that when I ordered (early 2008), I received the device and router in about 4 days, it ran as soon as I installed the software and it connected almost immediately. It was all pre configured with userID, password, etc. A few minor adjustments were needed to get the CDU to work in both the router and my laptop, but that took all of 3 minutes. Since then, I've had to update the firmware on the router but that took practically no time and it made major improvements in overall operation, so well worth the time involved, which wasn't much...like 10 minutes or so.

My contract ia almost up. I just got a post card from Sprint offering me $50 in service credit to renew for another 2 years. It gave me a good laugh.

I am in a chat session right now on this very topic. My account still shows the original date. Okay here's the answer
5:51:20 PM Agent One moment please, while I pull the account.
5:51:28 PM Customer Thank you.
5:53:50 PM Agent I am showing that the card is set to expire on 8/21/08. The contract date will not change.
5:55:31 PM Customer I think I understand. The card expires but not the contract. So, I will no longer be billed. Correct?
5:55:45 PM Agent That is correct."

I should mention that I asked the same question earlier today and got the same response. I sure the hell hope they got it right.

Question for some of you guys: When you canceled your Sprint account, did the expiration date change under your plan details on the sprint site? Mine still has the original expiration date of my contract, which is not til next year. The rep said my service would stop on Aug 6th. I'm wondering if it was done right.

I noticed the removal of "unlimited" as well. Now it says "EVDO Casual". I called to ask if this change reflected any change in my ability to use unlimited data and was told that it did not, that I still had an unlimited data plan.

This is now the fourth time I have been told not to worry, the 5 GB cap does not affect me.
That is retentions doing their job, trying to retain you. The cap DOES affect you, do not allow them to let you believe otherwise.

Well, just canceled the data card line. Notice of T&C change came with the July 25 bill. Things went real smooth in a chat session. So, down the road I'll have to check in with Millencom.
Forgot to mention: no ETF

Did anyone see the new notice on the bill? Its about paying within the due date. I think its another option to get out of the contract for those who are still behind bars with Sprint.

Also, my contract no longer states unlimited. I am one of the few who still has yet to cancel. I was waiting to how this would all play out because my contract is due in 2 months anyways.

Billing Information. This bill is due on the date shown. A late payment charge applies for unpaid balances and is charged at the highest rate permissible by law. Sprint Nextel will impose a $25 charge for each returned check. Service is subject to disconnection if payment is not received by the due date shown. Contact us first with any billing disputes. Disputes must be made within 60 days of the date of the bill. Charges that are not properly disputed will be deemed accepted and due by the date shown. Roaming charges accrued during the billing period may appear on subsequent bills because of third party processing delays. Contacting Sprint. For those who have switched to Millenicom, how long does it take them to get service up? I'm assuming it should be working by about the time you hang up the phone, correct?

btw, didn't have any issues canceling here, thankfully.

Just an update from Page 3...

After 2 more calls to Customer Service, I finally hooked up with a rep who would cancel with no termination fee. Just waiting on the bill now to confirm.

To answer the question about how long you have to cancel, they told me on July 17th that I waited too long. One set of writings I have said you have 30 days from the introduction of 5gb capped service to cancel, but the rep said that it was on Page 9 of my May-June bill, and supposedly only had 30 days from recieving that notice.

Either way, after hours on the phone, finally got it cancelled without paying the ETF. My advice is to keep trying until you get what you want.

Good luck all, I'm definitely steering away from Sprint in the future. Life is complicated enought without dealing with this crap.

That's correct, but you should do this only if you have time to be on the phone at least an hour or more. Tell the rep "Due to your recent terms and conditions change I would like to cancel my contract, however I would like to contiue using your service." They will tell you that it's impossible to end your contract without and ETF but tell them that per your contract, you have the right to cancel the contract due to this material adverse change. You may need to quote them the terms found on the contract and tell them where to find it. I had to read it to the women twice before she put me on hold to talk to her manager.

The Contract:

quote:
SPRINT/NEXTEL

When You Don't Have To Pay An Early Termination Fee
You aren't responsible for paying an Early Termination Fee when terminating Services: (a) provided on a month-to-month basis; (b) consistent with our published trial period return policy; or (c) in response to a materially adverse change we make to the Agreement as described directly below.

Our Right To Change The Agreement & Your Related Rights
We may change any part of the Agreement at any time including, but not limited to, rates, charges, how we calculate charges, or your terms of Service. We will provide you notice of changes that may impact you in a manner consistent with this Agreement (see "Providing Notice Under This Agreement" paragraph). Except as provided below, if a change we make to the Agreement is material and has a material adverse affect on you, you may terminate each line of Service materially affected without incurring an Early Termination Fee only if you: (a) call us within 30 days after the effective date of the change; and (b) specifically advise us that you wish to cancel Services because of a material change to the Agreement that we have made. If you do not cancel Service within 30 days of the change, an Early Termination Fee will apply if you terminate Services before the end of any applicable Term Commitment.

The following, without limitation, will generally not be considered changes to the Agreement as contemplated in this provision and will not result in the waiver of applicable Early Termination Fees: (a) changes to our Policies; (b) changes to rates or charges that are not a core part of the rate plan package for which you contracted - for example, incidental, occasional or casual use charges and other options that do not require a Term Commitment; (b) changes to Taxes & Government Fees; or (c) changes to Surcharges, including assessing new Surcharges.

Our Right To Suspend Or Terminate Services
We can, without notice, suspend or terminate any Service at any time for any reason, including, but not limited to: (a) late payment; (b) exceeding an Account Spending Limit ("ASL"); (c) harassing/threatening our employees or agents; (d) providing false information; (e) interfering with our operations; (f) using/suspicion of using Services in any manner restricted by or inconsistent with the Agreement; (g) breaching the Agreement, including our Policies; (h) providing false, inaccurate, dated or unverifiable identification or credit information, or becoming insolvent or bankrupt; (i) modifying a Device from its manufacturer specifications; or (j) if we believe the action protects our interests, any customer's interests or our network.

From what I've read, it's basically a toss up, depending on which rep answers your call. Sprint's CS is so horridly disorganized, the left hand doesn't even know what the LEFT hand is doing, much less the right.

so...how do you like the Instinct
Despite some software bugs I love it. This is my first touch screen phone, and it's got a lot of nice features I like. The TV and streaming radio are both good additional services and help pass time while waiting for your order at a resturant

I have been on the phone with sprint for 2 hours now and they are telling me that because I paid my bill which showed the change that I agreed to said change. I read them the contract and what is says about material adverse changes but the won't budge. What do I do now?

EDIT: After reading the TOS to the rep again and insisting that they talk to a manager, then waiting on hold for 28 minutes the rep came back on the line and put my account into month-to-month status. So my contract is now over a year early and I can cancel at anytime... here I come Milincom!

Edit2: Included a picture showing the expiration change they made; was effective immediatly. Sorry for the crappy graphics, I used paint.
