They are in open beta last time I had checked. The team working on it is a large portion of the original Diablo creators who left Blizzard. Titan Quest is the closest thing to a D3 before D3 was announced. Titan Quest is supposedly the best Diablo clone, but I've never played it so I can't confirm that.

Icewind Dale II was written by the same people as Netherwinter Nights II, and is supposed to be pretty good. It's predecessor wasn't that great, but this one got good reviews.

Dungeon Siege is another good one, very Diablo like and came out 2 years after Diablo II.
