Because if you did, you'd see that I addressed this point in my original post.<br><br>The hands-free laws for cell phone users are nothing less than complete hyprocrisy.  The entire rationale given for getting drunk drivers off the road is that these drivers are "impaired" and therefore pose a <i>potential</i> danger to their fellow drivers, pedestrians, etc.<br><br>But someone trying to drive and talk on a cell phone at the same time is <i>also</i> suffering from an "impairment."  That is, their attention is divided between their phone call and what is going on in the roadway in front of them.  Speaking as a cyclist, I don't care where a motorist's hands are: I care about where their attention is. As the old saying goes, you can't do two things at once.<br><br>And these hands-free laws are nothing less than an endorsement of "impaired" driving by the State.  The only difference being that cell phone users have the cell phone companies bribing politicians on their behalf to vote for laws that will allow cell phone users to continue to drive with their attention on two things at once (sorry, I meant to say "making campaign contributions" instead of "bribing politicians").  Meanwhile, MADD keeps wanting to lower the BAC threshold so that the legal definition of "drunk" is met by more and more people.<br><br>IOW: one type of "impairment" (drunk driving) is deemed unlawful by the State, while the other (talking on a cell phone) is deemed "officially" okay.  If that isn't hypocrisy, I don't know what is.<br><br>But my point is that the assumption is made that drunk drivers are automatically going cause an accident, even though they have a strong incentive to get both themselves and their vehicle home in one piece.  <br><br>However, if you want to criminalize any behavior that could <i>possibly</i> lead to an accident, (as drunk driving crusaders want to do) then it's only fair steps should be taken to ensure that <i>other</i> conditions that might negatively impact somone's driving should fall under the heading of "criminal behavior," too, right?  For instance, if someone drives with only four hours sleep, shouldn't they be arrested?  Likewise, if I've just had a fight with my girlfriend, should I be allowed to get behind the wheel?  Perhaps we can agree that driving while suffering from lack of sleep or an upset emotional state can also be deemed "driving while impaired."<br><br>The whole anti-drunk driving crusade has taken us down a road where behavior that has not harmed anyone is deemed criminal merely because there is a <i>potential</i> that it might harm someone.  Again, if someone causes an accident or kills someone, they should be held liable for doing so.  But we need to get the government out of the risk-management business because the <i>potential</i> for risk in any given human activity is limitless.<br><br>The OP's point is that law enforcement is now seeking to cost-shift and get <i>everyone</i> to pay for "needed" increased law enforcement.  But the reason why this increased law enforcement is deemed necessary in the first place is because more and more bahavior is falling under the heading of "criminal," even though no one has been harmed by it.<br><br>If you think getting a dollar (likely more) tacked onto your water bill for drunk drivers is ridiculous, you ain't seen nothing yet.  Maybe they could tack on another $5 to fund busting more pot smokers, too.  After all, if billing <i>water users</i> for busting "drunk" drivers (and just what <i>does</i> the latter to do with the former?) is A-OK, the sky is the limit.<br><br>This is nothing but cost-shifting at its very worst.  ]]></description>

If you visit the MADD website, you'll find it's long on emotional appeals, short on logic.<br><br>Likewise, my posting anonymously has nothing to do with whether or not my posts have the ring of truth about them.  My posts are there for all to see, and must stand or fall according to their own merits.  The worthiness of an idea has nothing to do with the character of its sponsor.  <br><br>And if you go back and read what I wrote, I did indeed say that anyone driving drunk who gets into an accident should be prosecuted and made to pay for the damage they cause.<br><br>But, again, there is nothing inherently criminal about having a few beers and then getting behind the wheel.  It is a choice that the particular individual is making and it is up to them to make it home safely....or pay for any damage they may cause.  But my point is that <i>unless they get into an accident</i> their behavior is not criminal in nature and harms no one.  All I am looking for is for people to start acknowledging that fact rather than treating drunk drivers as <i>de facto</i> murderers when they have done nothing of the kind.<br><br>I appreciate that people are indeed killed by drunk drivers.  But that doesn't change the fact that people driving on too little sleep, driving while upset, or driving whilst talking on a cell phone are also "impaired" and have the potential to cause accidents as well.<br><br>And yet, I see no campaigns to curb these behaviors or to throw those people in jail until they get enough sleep, calm down, or (God forbid) decide that their all-important cell phone call can wait a while.]]></description>

Should we conduct campaigns to jail people who insist on driving on less than eight hours sleep?  Or perhaps we can require new cars to give drivers tests to determine their emotional state before the ignition will work?<br><br>There is nothing inherently wrong with having a few beers and then getting behind the wheel.  I'm not sure exactly when people got it into their heads that it is, but it most assuredly is not.<br><br>I agree that if someone chooses to drink and drive and does cause an accident that they should be held liable for any damage they cause.  But people need to stop pretending that lives were, in fact, saved by taking a drunk off the road when there is no concrete evidence that said drunk would not have made it home safely on their own.<br><br>The cheerful hypocrisy of the State was made quite clear to me when I was told that California now has a hands-free law for cell phone users.  Speaking as a cyclist, I could care less where a given motorists' hands are.  Instead, I care where their <i>attention</i> is, and someone talking on a cell phone does not have their full attention on the road and their surroundings.<br><br>That hands-free law is the State's way of telling us that they, in fact, are perfectly happy to <i>endorse</i> people driving in an "impaired" condition. If I recall, though, Wrightstown (sp?) was an armpit. Had to stay overnight one time in the USAF NCO transient quarters at McGuire back in the early 1970's and checked the bars in the ville out. <br><br>What a sleazeball town! :D!<br><small>--<br>The maximum effective range of an excuse is ZERO meters!</small>]]></description>

It doesn't matter who owns the car. If drugs are found in it, it can be seized. I was informed my people in the know, it doesn't matter if you own the vehicle, borrowed it or leased it.
