The baby with the bathwater

quote:
... (T)he company would disabled all those with addresses starting with "alt.binary," which is where child-porn images are often exchanged. But not all such groups have child pornography.
I use AthenaNews for my Usenet access. Looking over the group directory, there are 12 "alt.binary." groups listed. There is no child porn group.

If they block the thousands of "alt.binaries." groups, they will kill the vast majority of porn groups, and the vast majority of file-sharing groups of all kinds. E.g., my old-time radio programs come from "alt.binaries.sounds.radio.oldtime" and "alt.binaries.sounds.radio.oldtime.highspeed".

IAC, all the ban would achieve is groups being renamed to evade the filters, e.g., "alt.binaires.", "alt.alt.binaries", etc.

Why ISPs should bother with the Usenet is another matter. It's arguable that 99.999% of Web users never heard of the Usenet. Those that know what it is have many options for accessing it apart from their ISPs.

If you have no fear of being branded as a pedophile, I wonder if this would be a way to get out of an ATT wireless contract which has data on it (such as iPhone 3g). "I just bought my 3g iPhone to looking at nude 18 year old boys and your blocking it is material change of contract. John in the Bronx."

You would get out of the ATT contract and right in to a Federal contract for a long term vacation in one of their greybar resorts plus court costs, err, contract fees.

I modified the "17" to an "18" in my post. I confused the age of consent with the age for kiddy porn in my original post. Sorry, I'm not horribly experienced in that area, but a little googling gave me a quick law lesson.

That's another screwed up thing with the law. Why is the age of consent different than the age at which one can be photographed without clothes on?

The problem is that we have too many laws and no one can stay on top of everything and harmonize everything. We are dealing at work with a federal statute where Section(A) says if you have an XYZ issue, you must go "here" and Section III(ZZZ) says if you have an XYZ issue, you must go "there."

In Kennedy v LA decided two weeks ago, the US Supreme Court struck down the death penalty for child rapists stating in part that there was no consensus for such as a law for this penalty and it was therefore cruel and UNUSUAL punishment. The Court stated that some of its evidence was there was no federal death penalty for such an act. A military law blogger then pointed that in 2006 Congress passed such a law. Apparently none of the Justices of the United States Supreme Court or the Office of the Solicitor General knew of this federal law. Doesn't that suggest that the United States Code has become an incomprehensible morass?

My state has a constitutional amendment on the ballot to turn our state into a part time legislature. Perhaps we should do the same with Congress.
