If you don't get you way, SUE! SUE! SUE!

This kind of crap only lines the pockets of the lawyers on both sides. The consumer will get almost nothing and probably some clearly defined monthly caps that are pitiful. Comcast will get a big bill from their lawyers and later pass that cost on to their customers.

All some some guys who are Linux ISO collectors can continue to trade rare and hard to find ISOs.

comcast never sees a bill from their Lawyers. They have a legal team and department like ever other company their size.

The most anyone will see is maybe a coupon for free service for so many days.

And like almost every company their size they frequently hire outside specialized counsel under certain circumstances. So there is no guarantee here that in house counsel will be all that is used.

SO the better alternative is to just take it on the chin when your contractual rights have been violated? The plaintiff didn't create the cause of action.

of course it does, but in a case like this it's the principle. This is the only way the little guy can fight the greedy corporations.

Yup, and they're doing it with all of the revenue they're making, some of it due to their shady business practices. You don't think Comcast knew they might be sued for implementing caps without disclosure. They knew how much they'd make and how much any potential lawsuits would cost them, and they went ahead with the plan. They made the bed, now they have to sleep in it.

I would think a better analogy would be more like this: you pay for your car (or perhaps a lease?), are promised that it can go 150 MPH, but can only drive it a certain numbers of miles per month or you lose the car.

That's no threat. I'd rather companies be up front with what they're giving you - even if that means it's no longer "unlimited". Once the price is up-front, then the market can decide what it wants (even in this less-than-competitive industry). The problem with caps isn't the caps, it's the lack of up-front disclosure.

comcast does not state their service is unlimited. Not many ISPs do anymore.
