Here's how caps should work...

1) Reasonable base cap based on an average users of a particular system. The ISP should have to publish anonymous data usage stats and clearly define the formula they are using to decide on a cap number.

2) The cap should never effect more than 10%-15% of the users. It should scale based on total average usage.

3) Overage charges should be a flat fee. Perhaps double the monthly price. So if you pay $40 a month for normal capped service, the absolute most you could ever pay is $80. (scaling for different speed packages, of course) I don't think $80 a month is really unreasonable for heavy bandwidth users at all.

4) Bits should roll over month-to-month. If you go over the cap by 10GB, but you had 10GB to spare last month, you should not be charged anything extra.

5) The ISP needs a reliable, easy to use, web interface to monitor usage. They need to notify me when I'm at 50%, 75%, 90%, etc.

6) The fringe top 1-2% of users should just be kicked off the service after a few warnings. You shouldn't punish 99% of your users because 1% of your users aren't profitable.

3a and 4a. have a Full speed with Overage charges or a lower speed with no Overage charges. Like FAP on sat / Australia IPS work.
