is this legal ? symaptico changes plans without permession..

i got my bill with $30 extra bandwidth charge. i called them, the first rep. told me that it was a result of the recent changes that i requested, then when i told him that i never requested anything and the last time i called them was more than one year ago, he put me on hold and then i was transfered to this lady (he said it was his manager) she realized it was a dead end trying to tell me that i requested changes to my account, so she didn't even bring that up, instead she lectured me that i am downloading way too much making it sound like i was committing war crimes (in a sneaky indirect way), and that sympatico no longer offer unlimited usage plans, and of course she started selling me one of their current plans, and she repeatedly failed to give me a clear answer on who gave them permission to change things without telling me. i interrupted her and said that i am not interested in hearing what she has to say about their current plans and that i was too mad and that my blood was boiling (true) and because i dont want our conversation to take an uncivilized path, i prefer to speak with them another time. so she let me go and i hung up

i read lots of posts on many site addressing the same issue. my only question is are they allowed to do that ? is this legal ? from what i know the company cannot change your plan without your permission. for example, i have the city talk plan from fido(fixed monthly rate regardless of the amount of minutes used) which is not offered anymore. just like sympatico, they try to get rid of every customer who has that plan, but still they never dared to change it without telling me so i still have it . even though they wont let me change the name on the plan to my sister's name who is the person who actually uses the phone, nor let me change my number or any similar simple things any customer would ask for without losing the plan. but again they didnt not change my plan just like that without my permission! the way sympatico did...

is sympatico allowed to do that ? isn't this illegal ? does anyone know anything about this ?

thank you all. of course i don't need to say that i am gonna call again and cancel my service, but i first need to calm myself down after today's irritating experience.
please all comments are welcome. we must all spread the word about these an ethical business practices. thanks again

They didn't change my plan without any permission, I was on the unlimited 5megabit profile. But I chose to upgrade to the 7 megabit profile (with a crappy laptop that broke down twice). and that capped me at 60gb/month.

I've heard of many people in the same boat as you man, and is it legal? probably not, but since it's bell, I'm sure they find ways around the "legal issues".

Bell owns all the lines across Canada and they are basically Canada's biggest corp, considering Canada doesn't really have her own corps to begin with.

Honestly man, try out Teksavvy. unlimited bandwith, no capping, no throttling, better tech service, rated #1 ISP in Canada!

Currently only offering a 5 megabit profile, but it'll speed up in time.

I tried everything i possibly could to stay with Sympatico, and all has failed.

You could always try giving their executive office a call. Appearently, if all fails, these guys are pretty good.

They were able to fix all my issues, one of them being my profile being changed to interleave all the time without any notification or permission.

Then they told me it would take 5-7 business days to change it back to fast path, yeah right.

I called the executive office, and one of the executives was able to change it back to fast path within 15 MINUTES.

So that says somethin!

i am going with teksavvy without a doubt, its just that i am so mad it's fucking eating me inside... i cannot believe how our government is not protecting us the consumers from these unethical business practices.

i would like to mention something i learned from my business classes in university, that often companies will willingly choose to discontinue serving "non-profitable" customers. so i guess this is how sympatico sees the users who have unlimited accounts. the way they see it is; they give us more than we give them, therefore we are a bad business for them.
however that doesn't mean that sympatico can just make up excuses to terminate or change plans by using trick tactics or acting without permission.

thank you for the contact information i will give it a try even though i don't believe it will do any good.

Hi, I had the exact same problem as you. What they are doing is NOT LEGAL! I called up the bell reps and I Said "So I want to cancel my internet w/out the cancelation fee because you guys have obviously violated your terms and conditions." Bell rep says "Sir I agree, but there is nothing I can do... I can cancel your subscription, but you'll have to pay 100$." I was SOOO ANGRY so I just went on the direct form to post my anger... I think Martin replied saying that he would wave that 100$ off, however, it took him about a month (or a very very long time) to reply. I was really pissed off, so I went to a blog site called "ON YOUR SIDE" where there are 500ish complains about bell, and it has a top ranked bell residental rep. All i did was email him about my issue. He had his secretary call me the following day! Very fast indeed and the matter was settled.

site is here: »www.ellenroseman.com/?p=8

Hope this helps dude.

they just did that to me yesterday and yes its illegal, they do not have the right to change your thing without your complete agreement and yes its breaking their conditions which mean you can stop your business with them the next day and if they say no you have to pay then they are going against the law therefore you can call media or whatever to denounce them

Stop wasting your time with these monkeys. File a formal complaint with Consumer Protection/Better Business Bureau

They'll take it up with Bell directly.

You might find this one useful too:

Ok first of all Deadpool is far from a noob. We don't see eye to eye on a lot of points, but he knows his ways around

Bell's stuff, so cut the pseudo L33T crap and buzz off like a nice anonymous coward troll.

Edit: Spelling and editorial review.

Just a FYI thought it is true that Teksavvy doesn't cap or throttle, Bell has now forced throttling on all lines, including Teksaavy's and is in the process of applying caps to it's wholesaler's "future" customers (after jan 2009).

Teksaavy and CAIP are fighting the throttle and the CRTC has to approve any nonsense Bell tries to push down our throats.

Point is, if you do the switch and plan to move again later: do it before Jan 2009, cause you just never know.
And no matter which DSL ISP you deal with, you are likely throttled by bell... for the moment.

That's exactly what I was thinking, grayfox. He's been very helpful to me personally and I'm not even a Sympatico customer fer crying out loud.

So why not cut the guy some slack, he's trying to help someone as grayfox has already pointed out.

Is this legal: Symaptico changes plans without permission?

I've have a few issues with Bell, probably not to the extreme that most have expressed on DSLR. However said, there is one lady at Bell Canada that I make contact with when issues arise, which is far and few between.

Her name is Dione Tomlinson, Executive Resource Associate, Executive Care, Bell Canada: Managing and Resolving Customer Complaints.

Those few times that I have had to call Ms. Tomlinson she is pleasant and very professional and has resolved my issues within minutes.

A couple of weeks ago I cancelled the Wire Care Maintenance Plan with Bell Canada. The CSR applied a $35 charge to my account for cancelling the WCMP before the first year agreement. All attempts on my part to explain to the CSR that cancelling the WCMP within the first 30 days I would not be subjected to a cancellation fee was to no avail. A quick phone call to Ms. Tomlinson, my account was credited back $35 as she agreed that cancelling within the first 30-days there is no cancellation fee. Ms. Tomlinson can be reached at 1-800-353-9077.

To sum, there are people at Bell Canada who care enough to help. What we fail to realized, is that, the CSR's at Bell Canada are only following Policy and Procedures as handed down from the top Executives. Can the CSR's be faulted for doing their job? Does not your place of employment have Policy and Procedures to follow? The CSR who handed my call was in training and not aware of the 30-day grace period, as explained to me by Ms. Tomlinson.

I don't agree with most things that Bell Canada is doing, however, kindness and politeness goes a long way in getting matters resolved to your satisfaction.

Re: is this legal ? symaptico changes plans without permession..

i will keep you all updated on any developments. on Monday i will hopefully take the first step and call them the regular way (310-surf) and speak with whoever will answer the call. and then i will see where things go from there.

Good luck with that. Bell seems to think they can just keep raising their prices and consumers just take it up the ass. When you look at what they are doing with all their services, you are paying more and getting less.

Bell.. Making things complicated.
