Acceptable use policy

Frontier DSL is all that there is where I am. When I signed the contract two years before this cap I signed onto their acceptable use policy that was then, so shouldn't I be privy to not have to up with this @^$*? And thus frontier according to the older acceptable use policy have been in a binding agreement with me to provide such uncapped services?
