Psystar may actually have an anti-trust case against Apple.

Miami-based Psystar, owned by Rudy Pedraza, will sue Apple under two federal laws designed to discourage monopolies and cartels, the Sherman Antitrust Act and the Clayton Antitrust Act, saying Apple's tying of the Mac OS to Apple-labeled hardware is "an anticompetitive restraint of trade," according to attorney Colby Springer of antitrust specialists Carr & Ferrell. Psystar is requesting that the court find Apple's EULA void, and is asking for unspecified damages.

I doubt Psystar will win, but I sort of want them to... of course, this is mostly because I am tempted by the Mac OS X in general, but Apple refuses to offer a laptop with a trackpoint, and going to a touchpad would be too much of a step back... (Obviously a wireless mouse is the ultimate ideal, but that doesn't work in a lot of mobile situations)

Well, Psystar may win .. But in the end, it comes down to has more money. I think Apple has a bit more cash in hand. On that note, Even if the EULA is void, Apple can still make sure that the OS only works with it's OS.

Psystar is really trying to make money off other people's work. The Hackintosh community has done the driver hacking already. Psystar has just put it into a package.

Can they? The problem (yes, even for Apple) is backwards compatibility. They can't update all of their Macs with a security chip and then tell everyone that only new Macs will get Snow Leopard OS X, so all older Mac users (whose Macs don't have the chip) are screwed. Now, they could introduce the chip now, but even Apple would have to wait a few years. (Much like how Snow Leopard is rumored not to work on PowerPC Macs- they've had several years to upgrade to Intel and now they can reasonably drop support)
