They don't have to. They are welcome to offer service on the UTOPIA network, as is Comcast. They have simply refused, and chosen instead to litigate against it.

So Qwest obviously isn't competing on price or features in that area. How about Comcast? Any sweet deals to keep customers on their system? FiOS-calss competitive strategy (DOCSIS 3 coming, Blast already here?) or no? Trying to litgate is just disgusting, though when a municipality comes in there's no wink wink nudge nudge collusion between telco and cableco...
