 The private companies are selling data around the world

This is just an NSA possibility, and not proven as true by this story. But these firms mentioned in the story are foreign private firms that collect info from all countries and sell this data around the world.

a number of private companies now sell off-the-shelf data-mining solutions to government spies interested in analyzing mobile-phone calling records and real-time location information. These companies include ThorpeGlen, VASTech, Kommlabs, and Aqsacom--all of which sell "passive probing" data-mining services to governments around the world.

After describing all the ways that the government could legally collect real-time data on millions of U.S. citizens, Gidari said that essentially, the existence of such a program would likely remain a secret (barring a whistle-blower or leaks to the press by government officials).

Ohm said that Congress would not be too happy:

If [the sharing of data by niche telecom providers] is seen as allowing an end-around an otherwise clear prohibition in the SCA, Congress is likely to throw a fit when it is revealed and try to amend the law. DOJ is sensitive to this kind of thing (despite what the NSA wiretapping program would lead you to believe) and would probably try to avoid blatantly bypassing otherwise clear language in this way.

Aqsacom based in the Czech Republic.

Short version: NSA getting and using info this way is possible and apparently legal. But it doesn't mean they are actually using this capability on U.S. data.

If the NSA had the ability to acquire this cell data, without oversight, do you believe the NSA would

A) Take the opportunity to acquire the cell data without oversight
or
B) Not Take the opportunity to acquire the cell data without oversight.

Do you believe the Technological Ability to acquire mass cell data exists?

A) The ability to acquire mass cell data exists

B) The ability to acquire mass cell data does not exist.

I'd choose 'A', and I'd also choose 'A'.
However, I know my mind and I have the precious little courage that it takes to openly reveal it.

The NSA might NOT be clandestinely acquiring cell phone data without oversight.

It's just significantly more likely
that they ARE collecting
our cell data surreptitiously.
