| [Serious] Camera in a Bathroom - Illegal?
Is it illegal to have a camera in a public bathroom?
I won't say where I work other than it's in the hospitality industry but we just found out from one of the managers that the owner has put a camera in the mens bathroom and only the mens bathroom that is used by customers, due to apparent repeat vandalism! There is a warning sign on the door of the bathroom that the property is under video surveillance for security reasons but it does not specifically say that there is a camera in the bathroom.
Honestly it does not come as much of a surprise to me that there is a camera in there because our entire work place is under video surveillance it's like Fortnox you can't hide anywhere or do anything wrong because you will be caught!
But seriously in my eyes this has gone way too far and if it's not illegal it should be!? -- Stec-Net Online Community! |

| The rule is that you can not "see" the uranels, or directly on the toilet.
Being able to see the sinks is considered proper. |

| reply to StEC Wow I guess I will have to take a close look and see just where this camera or cameras are then. I have not actually gone in the bathroom yet because I have no purpose being in there but when I am off duty I will take a looky. -- Stec-Net Online Community! |

I don't know if it's legal or not but I've never seen cameras in bathrooms. |

| I'll add:
Your find camera's in these situations in certain locations.
I know some high security buildings I have been in have had camera's in the bathroom. Of course, these same places had "no newspaper" rules for said bathrooms as well. |

I have seen a camera on each stall door, the sink, and to the "backs of the people" at the Urnal.
You really see it most in "high security" locations. And then, only rarely.
The main issue is, people consider "cameras" security. When it's not. They will help you find out who did something, but not stop it. |

| reply to StEC I would recommend looking into the specifics on this. I know that where I work is a high security area and we do not have cameras in our bathrooms or my office either.
I'm not sure the specifics but my understanding is that it has to do with the camera being a confined space. |

| reply to StEC i don't see anything wrong with it...if the bathrooms have been targets for vandalism, it might help identify/prove who did it...i know if owned the place, i would get pretty sick of wasting thousands of dollars on repairs to a bathroom all the time. -- Best Marketplace Ever: »www.cbc.ca/marketplace/speed_bumps/

One word to describe why it can be considered wrong.... Privacy.
I know this story is out of Quebec but the owner of the store had to remove the dud camera he had installed because of privacy concerns etc.

I would seriously consider advising your boss to seek some legal council on this so that he does not find himself in any legal hot water over the installation of this camera. |

Correct. That would apply to the entire bathroom, not just the stalls, or urinals, under s.162 of the criminal code regarding voyeurism. Bathrooms can also be used as change rooms.

| reply to StEC Ok I took a look and it's not too good. The camera is not very noticeable unless you are specifically looking for one and it's angled in a way that if you are standing at the only urinal the camera is aimed directly at your back. Now I know for a fact some people for one reason or another turn around and still not have tucked their junk away so I'm sure they have more than one penis on cam or even some butt shots!
As for Pepsi and his....
quote: if it says it's under "video surveillance", how could this be taken for anything but a video camera inside the bathroom?
remark..... the mens bathroom is directly at the end of a hall and a good place for a sign to warn people of video surveillance I suppose but the sign does not say "video surveillance in Bathroom" It only says "PROPERTY UNDER video surveillance" which is a very vague and common sign! -- Stec-Net Online Community! |
