Ask them how to disable the program entirely. And any other programs you have that might do this by accident.

I would just call and explain to them that you would like them to remove the charges because it was a mistake and you haven't ever ask for the refund before.

  I have America's Choice II Familyshare 700 Anytime minutes and unlimited N&W/in network.

2 phones totaling $69.99 basic charge.
EVDO is 'pay as you go'.

During the most recent billing cycle, my girlfriend pulled her phone out of her purse and noticed the medical information database program Epocrates was updating. She immediately stopped it as we previously had a large EVDO charge and knew it was not something we ever wanted to use. Verizon cannot disable EVDO. Epocrates is now set to NOT auto update. She was not aware it could auto update as this has never happened in the past 3 years with this phone model.

We were charged $107.01 for 7134 kilobytes.

The phone is a Palm Treo 700p and is always locked by default. It requires two button presses in succession to unlock.

Do I ask Verizon for some leniency on the charge?
What would be the best way to frame my request?
