So does the government... every day. They willfully write laws that violate the constitution all the time. Its why their laws get challenged in court when they violate the constitution. (However, the courts are often told they legislate from the bench) I could go into a topic now, but won't, on how the FCC is BROADLY over reaching its power and how the congress doesn't even have the right to empower the FCC with the authorities they have. (ie: the only body of government that has absolute authority to impose fines is the judicial branch)
