said by mr weather  :And if they had been killed the shooter would be up on a capital murder charge which allows for the death penalty in NY state. Actually, the NYS Supreme Court struck down the death penalty law a few years ago. There was talk of introducing a new law specifically for murder of law enforcement officials, but I don't believe it's made it through the legislature.
