Your definition of failing in this matter is different than mine. The fact that they are EVEN ABLE to sue is a "win" for them! Perhaps they may "loose" the ruling in this case, it still won't prevent them from targeting the next guy... and sick their lobbied bulldogs after them!

It's kind of like spear-fishing! The hungry one is going to make a LOT of misses, but eventually he'll hit the jackpot... making his efforts worth wild! Rinse, and repeat!

Sure, The MAFIAA can afford it - but the ISPs cannot afford to lose money on legal fees. Eventually they'll just resort to giving up and letting the MAFIAA have what they want.. "just don't sue us".

Real mob: "do what we tell you to or we'll break your legs"
MAFIAA: "do what we tell you to or we'll break your wallet"

Same difference, same end result. (eventually)

Governments need to step in and stop this by outlawing frivolous lawsuits like this.

Ok, so college students are the unwilling, primary investors in the RIAA's cause, but I think that the ISP's have a ton of money, and a lot of resources. If this was not the case, we'd already be knee deep in the same crap that the much smaller ISP's in Australia are involved in.

Comcast, AT&T, and Verizon are not as easy to push around. But that is the only thing saving us all from a disaster at the hands of the RIAA.
