When they took over my business (SunFAST DSL) in September it was obvious where it was going. A company doesn't breach contract for a few hundred customers, it has to be bigger than that. It was, it is and it is ALMOST over. There is still the question of SunFAST DSL customers that were ILLEAGIALLY taken! A warning to some of you (you know who you are, I have written statements from SunFAST DSL customers in regards to the slanderous statements that were made against SunFAST DSL to try to win over our accounts. I KNOW what went on about the "cash" being offered for the close of the next SunFAST DSL customer. I know how you turned customer sales into a "boiler room" environment and how you exibited such disconcern for the customer and such disregard of the law. BE ADVISED - this is going to the FCC and WILL be investigated. If your name comes up in the report, if you were one that "harrassed" my customers, it is now you day.
To the employees that were unfortunate pawns in this game, again, I am sorry for your loss.
In some sad way I almost feel vindicated.

Just as Zyan is having financial difficulties so did you. SunFAST did not pay their Zyan bill. When many of SunFast End Users attempted to contact them, The telephone would just continually ring without an answer or voice message. After a few weeks, what did you expect your End Users to do. Just wait around till you woke-up.
Most SunFAST End Users were intelligent enough to realize that SunFAST only Reselled Zyan DSL and after a few weeks of them unable to contact SunFAST some did decide to come abroad with Zyan or switch to another service provider completely.
What would you have liked them to have done, "Have no service", because obviously you were unable to provide them with the simple courtesy to answer the phone instead of a constant ring no answer.

Were you one of the ones on September 8th that called our customers and told them we were out of business? Or were you one of the employees that double billed us and then billed us $98,000 for appx. $3000 worth of services? Or were you one of the employees that put us on hold for 4 hours at a time for tech support? If you are looking at it you will see that there is a paragraph signed by "the devil" himself that states clearly "Any termination of services require a 15 day notice" ... secondly I am not posting to say "I told you so", I have gotten on with my life. However, I have been contacted by at least a dozen ISPs in the same situation as my company and I am trying to assist them in legal issues as well as reprovisioning of their DSL. I would hate to see more people out of work because of one persons huge failure to deliver. |

Are you Steve Barbee?! Or a close friend or aquaintance? Just a hunch.
If you are, and even if you aren't, Tori has every right to be infuriated. If you have ever run a business, you pour your heart and soul into it. Her business failed because of alleged unscrupulous activity by Zyan. Telling her to get on with her life, is like telling a crime victim to just let it go. Tori and all the others who were screwed over by Zyan will have closure, when the FCC and the Federal authorities investigates the alleged activity and brings those responsible to justice.
The key here is that there wasn't enough oversight of this industry to begin with, if Steve Barbee is the "devil" as you describe him, what the heck is he doing running a DSL company?!
Karma is a search warrant and 150 Federal Marshals breaking down Zyans doors.

It wasn't just a company that Steve Barbie and the Zyan management took from me. That could be valued in dollars and cents. It was a reputation, friends, collegues and most of all my WORD and promise that was stolen from me. There is no value that I can place on that. |

Now, to the rest of you out there who have been trashing Sunfast for their supposed poor business acumen: No one is a psychic. If you are let me know and I will hire you. All any business can rely on is the contract and the word of it's vendor. When Covad forced, and I mean FORCED, small ISPs into the distributorship channel, it was like throwing chum into shark infested water. Covad only offered my company 5 potential "authorized" distributors. One of them we had dealt with before and knew they had terrible service/billing. Another wanted us to commit to outlandish quarterly sales milestones with huge penalties. The third was already an ISP on the way down (and made no effort to conceal the fact that they would compete with us directly for customers). The fourth simply didn't resell ADSL because it "wasn't profitable" and would only resell SDSL to businesses. The last choice was Zyan who had written promises of good service with credits to end users if they failed on these promises, had good pricing, and who worked with us on 5 drafts of a contract before we signed. Now I ask all of you: Why wouldn't you go with Zyan in that situation? Did all of you know that the DSL market was going to swing this way? If you did, shame on you for not blowing the whistle. The only prediction I or any of my associates would ever make was that $39.99 ADSL would never make a profit for anyone. But hey, that's just comparing the actual cost of bandwidth, lines and facilities to what was being hyped. Covad gave up relationships with small ISPs at their own peril. Small ISPs typically pay their bills and have solid, loyal customer bases. The trouble is, we don't grow fast enough to drive up the price of stock. And there you have it. That's my story and I'm sticking to it. |

What is that your cousin or someone you just went down on in the bathroom of some bar to get it printed? It is one of the most irresponsible examples of journalism I have ever seen, it's talking about things that are hear say and one sided. I for a FACT know that your flippin company was unresponsive to any of our needs as customers and at least going over to Zyan helped save my wifes small on line business, we have now going to go with Cable and Zyan may not be much better than you, but only Zyan gave the opportunity to do that prior to being whacked off. And they didn't solicit me, I had to almost beg to have them takeover my service. Where were you? Certainly not answering your phone. I'm glad your losing your house, you deserve it . . . by the way, my family is doing quite well and just bought a brand new huge fridge, would you like the box? And before you ask, don't worry about what my name is, you'll see if on your list of Discovery if you actually do sue Zyan, I have given them my information as a witness against you and your joke of a service. |

It is typical in lawsuits for both sides to file Discovery Motions, this is where all the info is. The meat of the suit if you will. Investigations are made and witnesses are spoken to and then subpoena are sent (this is very broad strokes people, I know there is a lot more to it)

I must admit that much of what was said about SunFast above was true. I paid several hundred dollars up front for the service, and it took nearly 6 months to finally get it installed. It turns out most of that 6 months was a result of SunFast not properly following up with Zyan, Covad, or U.S. West on what the problems were. During that 6 months, there were times where I wondered if SunFast was a real business at all, or if I'd simply been taken in by a scam. At one point there was an entire week where everyone left the offices for some reason leaving only an answering machine behind to support their customers.
In fairness, towards the end of the 6 month period, it appeared that SunFAST was beginning to pull things together. I was actually able to reach a person every time a called. They were polite and courteous and seemed to know what they were doing. I actually spoke in person to Victoria Proffer on several occasions. However, still no service. I was in the process of working out the details for the return of my up-front payment when miraculously I got a call from SunFAST informing me that US West would be out to do the line install the next day. Two weeks after that Covad came out and turned the service on! Believe it or not, it actually worked.
What I had purchased from SunFAST was a residential IDSL account. However, Zyan didn't offer residential IDSL, only business IDSL. I believe this one fact was behind most of the 6 month installation delay I experienced. It appears that SunFAST finally got the service installed by requesting that Zyan set up a business account ($89.00 direct from Zyan), and turned around and sold it to me as a residential account (for which they charged me $49.00/mo).
When I talked to someone at SunFAST about this detail, they assured me that it was part of their VAR contract with Zyan and that I didn't need to worry about it. Fine! Far be it from me to question getting a 5-IP IDSL Business account for $49.00/mo.) In retrospect, I suspect that SunFAST may well have been overselling and undercharging for their service...but this is nothing more than a guess on my part as I have no idea what the contract between SunFAST and Zyan actually contained.
The transition over to Zyan was nothing less than a Nightmare. If I wanted to keep my service, uninterrupted, I had no choice but to pay their price for the service I was getting. This sounds reasonable, except that all I really wanted in the first place was a single IP residential account! In order to make this change, Zyan insisted that I would have to cancel my service and go through the entire (painful) installation process again, which meant being without DSL service for who knows how long. I spent several days trying to work something out with them. Eventually my account was disabled. After two days, I finally called back and agreed to pay $89.00/mo and keep the 5-IP addresses. I signed a new contract with Zyan. To offset the extra price, I started a small business selling Windows CE games from my homepage. Since that time, while the service itself has been fine, I have had numerous other 'administrative' problems with Zyan. They inadvertently turned my Domain Services off, which disabled my e-mail and web page, essentially putting my small business out of business. It took a week to convince them it was an error. When I finally received my bill for service, they incorrectly billed me $99/mo instead of $89/mo, which was clearly stated on my contract. 3 months and numerous phone calls later, they still haven't fixed the problem. Given the billing problems I've had, it doesnt take a stretch of the imagination to believe that perhaps Zyan did over bill SunFAST. |

Re: Are you Steve Barbee?! There is a question on both ends of the fence as to who messed up the relationship first, sunfast or Zyan... This is not to say either side was right or wrong, just to say this... As a former Zyan employee who left before the collapse, I know that when I joined the company (when it was still small in cramped quarters)there were honest people who succeeded in building it into a larger company, despite Steve Barbee's influence. Then came the reseller push, and I did not stay long after that. Salespeople lying directly to people's faces, a department of only a few people working 16-20 hours/day, 6 days/week trying to clean up the mess, etc. Who pushed this? "the devil himself" I apologize for the manner of my former co-worker, but I for one, realize why so many are so bitter-We knew the lies, and some of us left because of them, but we all never expected to be lied to ourselves...
