I agree that throttling during prime time is a much better solution than a monthly cap, as long as they are open about it. A monthly cap does not really address the congestion issue as an individual can stay within the cap and do all his downloading during prime time, causing massive congestion. On the other hand, a person can download double the cap during off hours without causing any congestion.
