[TWC] OMG I Feel so violated! What if someone got KILLED?

First I got the dead RR line and then the email from Time Warner accusing me of theft... now they throttle my connection? I think my line is specifically being targeted now. So, how to test... or what to do? THAT is the real question.

For everyone... what to do to get a better line? Not just for this new P2P issue, but in general?

What if I was "special" somehow, and got an untapped line? How to be "special"? (note, not "illegal")

I didn't think anyone was listening. The short version is that RR is in FACT throttling my connection and I want to keep an eye on exactly what they are up to. I am about to install the DeeEnEss client to do just that.

The long version is much more fun...

About feeling violated, noted in the subject text: I did not like the fact that my ISP is cooperating with another organization against me... especially one not directly related to law enforcement (but that brings up a whole ton of schmack).

What happened: My line was killed and I was contacted by Time Warner RoadRunner that I was stealing from the RIAA (or some other IP holder). I was forced into a VERIFICATION ACKNOWLEDGMENT web site (where I was to assume guilt and make a promise to take action) in return for the restoration of my service. This is way outta hand for an ISP, and it is going to kill them soon if they don't change their ways.

Same thing happened to a friend of mine yesterday, from another city but the same TWC (RR) provider.

The bigger problem is now they are totally throttling my P2P bandwidth. In fact, if I so much as ping the wrong IP now my entire connection resets itself. Totally kills everything, even my VoIP line with emergency services (911) on 'em. They are going to be sued out of existence if they don't fix this.

Time Warner has EVERY right to discontinue your service, if you are violating ANY of the Terms of Service.

If you are indeed downloading illegal material, and caught, then yes, they have every right to disable your service. Nothing you can do about it, except that you got caught.

You lose all rights and credibility if you downloaded illegal material and got caught.

Actually, since you brought it up... the opposite is in fact the case. What they did is illegal, and they will stop... hopefully before someone dies.

There is really very little illegal material to download on the Internet. I've only found a couple of sites which had it; and they are long gone.

OTOH, there is a lot of illegal downloading of otherwise legal content. Make sure you state the facts as accurately as possible. Including an acknowledgement that, outside of a criminal court of law, you can't prove that somebody was doing something illegal on the basis of the evidence presented by a typical RIAA complaint. Inside that court, the accused is presumed innocent until proven guilty. Outside of that court, guilt is not the issue; just a tort.

The "notice" was a self-expiring web page that had the info you want (like that is going to help their case; it's detrimental at best)... so I don't have it on hand (but I can regenerate that data if necessary). I suppose if you wanna chat about that sorta thing just PM me... but that is again going off-topic...

Hint: Don't download not upload materials you don't have distribution rights of.

It could be me, but I thought that with all the media attention, it isn't THAT hard to understand that you can't upload copyrighted material, which is what P2P does.

Apparantly, TWC is one of those ISPs..... and you just got busted uploading copyrighted materials.

There are some other questions that follow, some real close to the first one (I just quickly counted seven question marks in the first message alone)... did you even read the message? Pay a different provider for better service or pay your current provider for a higher tier of service. Uping copyrighted stuff will get you busted though...

This is called getting "busted".
Last I checked, an allegation of theft can only be acted on by a District Attorney, or the like. For the instance of unauthorized distribution of IP, an allegation of theft in a civil breach of contract is just plain wrong.

However, without seeing the actual notice, nobody has a clue about what was alleged in the notice; and all discussion assuming the worst is, IMNSHO, out of line.

Sounds like you are on "probation" with your isp. Their next course of action might be to disable your rr connection entirely.

So I have a few things to say. You obviously were uploading or downloading, in some form of P2P. How they catch people is they seed a fake or sometimes real file. Then all they do is look at the IP's leeching it, and send letters to the ISP's, who MUST track every single address they lease or provide. Every time you change your IP Address RR logs it in a server, period. There is no way you were mistaken for someone else, etc...

Now to your other complaint which is someone answering your questions in your orig. post.....

Your line isn't targeted, RR has Millions of users, and to keep tabs on a single user, isn't worth their time. The e-mail didn't accuse you of theft, the e-mail said they had a complaint against the IP Address you had at a certain time. Goes without saying, that you, or someone using your connection (i.e an unsecured wireless router) was caught doing something.

There is no way to test to see if you are "targeted", you can't do anything about it. Are they throttling your P2P, maybe, but who knows.

To get a "better line" I am assuming you could pay for a higher tier, which yields more bandwidth, or switch companies.

There is also no way to get an "untapped" line that is legal. By "untapping" you would have to unlock your Cable Modem, which is illegal, and can't be done anymore. As well this isn't like phone service, where someone has a physical tap installed. They aren't "on your line" and physically have tapped into it. Your "line" is shared by everyone else in your neighborhood, potentially 500 people or so. If they want anything, they will track it by IP.

As well, from the title, stating "Someone could have been killed" I am assuming you either subscribe to TWC's VoIP service, or have VoIP of your own.

If you subscribe to TWC's VoIP service, then they will kill the HSD portion of the modem, but keep voice active.

If you subscribe to your own VoIP provider, then obviously killing your HSD kills your phone. Is it messed up and wrong, yes. Is it TWC's responsibility to track who uses VoIP on their system, no. That is one of those things, that until something bad happens because of it, then it will continue to be ignored. I see your problem though.

I would have thought that might be a good idea rather than posting many unsubstantiated accusations on this board.

I do not remember a time that TW interfered with any connection other than to shut it off. Certainly had they been doing that it would have caused many threads on this board.

1. it is against FCC rules to single out a service, such as P2P, and throttle it, and ISP's HAVE been fined for doing that
2. many innocent people have been accused of illegally sharing files, and been proven innocent.
3. under "fair use" you CAN distribute part of a movie, song, or program, so long as it's not the whole thing.
4. all of this CAN be substantiated, if not here, then in the ISP NEWS section.

yes the op does not offer anything other then bitching that TWC "killing his voip line" due to a TOS issue tho he reverts all answers against the poster, instead of answering questions

however it maybe FCC rules but a "compromised system" such as port scanning, TWC and any other provider is going to lock that connection or kick your butt off that system UNTIL its resolved, again falling on the END USER!!!! it is and i repeat it is the RESPONSIBILITY OF AN END USER TO: maintain that broadband connection no matter how you slice it.

if you dont know how to setup a proper firewall HIRE someone to do it. its no different then taking your car to service it for "maintenance"

a GOOD FIREWALL will prevent the likes of being hacked, taking proper steps to STAY AWAY from "hacked" sites ie: the million porn sites, sharing apps/files sites thus compromising a system is also the END USERS RESPONSIBILITY not the ISP's. many think i got a pc, lets see what i can see for "free", hear for "free" get for "free" and most will goto any lengths of doing it without thinking RESPONSIBILITY!!!

The FCC has no say over a compromised system relating to a computer that has been hacked. Now, if someone hacks your wireless router and makes it transmit at 200 times its authorized power limit, then they might get interested.

No, many guilty people have been rightfully accused of illegally sharing files but weaseled their way out of it. Having charges dropped, settling, or having a jury find you innocent isn't the same as being "proven" innocent.

2. No. There has been only one trial, in which the accused person was found guilty. That verdict was later set aside. No one has ever been "proved innocent".

Can you restate your questions? What exactly are you trying to accomplish?

Are you trying to fix the internet disconnects? If so post the signal levels of your modem or a better description of what seems to cause the disconnects.

Are you trying to have more reliable p2p connections? If so post your current p2p configuration including software used, version, connection counts, router make/model/firmware, and if encryption is being used.

Are you trying to fix problems with your VOIP? Post your VOIP setup and provider details.

Are you trying to track this throttling? Post details of what happens and we can help better.

So far your postings lack critical details to provide ANY REAL HELP and nobody here seems to be suffering the same problems as you.

You keep saying that you haven't done anything illegal and thus don't deserve this treatment from TWC, but in your second post, you claim that you DO use P2P. Let me guess, you just download a lot of copies of Ubuntu?

You keep saying that everyone is going off topic by saying it's your own fault that your connection is being throttled, but it's the topic that YOU started. YOU claimed that your connection is being throttled and that they accuse you of copyright infringment, and you admitted that you use P2P. You started this topic.

You also answered your own question - your connection is being throttled because you use P2P. If you don't like it, switch providers because TWC has every right to do what they are doing. It is in the TOS and AUP which you agreed to when you signed up for service. Also, they are like any other public business - they can refuse service to anyone for any reason.

If you don't like it, your only remedy is to cancel your service with them.

Also, if you're looking for sympathy from DSLR users, you've come to the wrong place. We as a community cannot and do not support illegal P2P. And we certainly won't feel sorry for you if you get cut off for doing it. And you have ADMITTED to doing it.

So shut up.

That right there indicates the OP knows he was doing something illegal (how much LEGAL p2p do you know that is out there?).

As far as I am concerned, he is only trying to get a reaction and is just sitting back laughing at people's replies.

So, nobody answered your questions directly because some of the details are unclear. Hope you don't mind if I ask a couple first, in order to give you a clear reply.

1. What P2P application are you using?
2. Do you have a way to throttle it in the application, or is it running as fast as it can? In other words, how much of your available bandwidth up and down is being used by the one application? One way you can answer that question is by running a speedtest while the P2P app is also running. The speedtest will give a fair ballpark value of what's free.
3. Is VoIP your only telecom dial out?
4. What happens to your connection when your P2P app is not running? Can you ping any address freely, or does that action still cause your disconnect?
5. When you experience your disconnect, what do you have to do to get it back? It sounds like you are experiencing a problem that is not permanent, but I may have misunderstood. Do you reboot the modem or what?

The above questions are for the hardware or technical aspect of your questions.

6. What kind of files do you download, and consequently upload, in the process? Not saying anything about legality or morality, just want to know. Linux distros, music, movies, what? In other words, why do they think you need a letter? I doubt it's because you're using the app, it's probably what you're using the app for.
7. Why do you think they are targeting you unfairly? This is sort of a different way to look at question 6.

Give me some feedback, and I'll have a better understanding of your questions.
