said by plvick :What are you talking about? Are you the TOS Police? Do you work for RR? I wasn't "caught"?! In fact, who said anything about that? I am doing nothing illegal, and that was not the point. Why go off-topic? You obviously have some nefarious agenda and are due some extra attention. Actually, since you brought it up... the opposite is in fact the case. What they did is illegal, and they will stop... hopefully before someone dies. Whats with the hostility? Gezz. Some people need therapy more then others, I suppose. Throttling isn't going to kill people, grow up |

So I have a few things to say. You obviously were uploading or downloading, in some form of P2P. How they catch people is they seed a fake or sometimes real file. Then all they do is look at the IP's leeching it, and send letters to the ISP's, who MUST track every single address they lease or provide. Every time you change your IP Address RR logs it in a server, period. There is no way you were mistaken for someone else, etc... I can't believe that everyone is good with this? Like it is totally fine, and could never mistakenly target an innocent person/etc? I just MUST be guilty. It is just so strange. What seems even more strange is the fact that it is all anyone really wants to talk about. The legality and ethics. It has been discussed to death everywhere and was not why I opened this new topic. I just think it is weird that things go like that here. Also, you mentioned that "who knows" if they are throttling... well, I do. I can see them doing it, and that interruption in my service kicked it off. I am going to use wireshark to get a grip on it. About "someone being killed"... I was referring to 911 emergency services, which my VoIP with 911 is provided by Vonage so it was killed (in fact, I was on the phone and the line dropped, so I know it happened). However, the threat is not limited to that. There could be all sorts of things going wrong that an interruption to service like they did to me could trigger, serious things. The 911/VoIp thing is just the easiest to communicate. As for "bait torrents": If it is a fake torrent, just file-named StarWars720p.mkv (or some such schmack) and I participate in the P2P of the file, I have done nothing wrong. Remember, it's a fake torrent, so I have not really propagated anyone's intellectual property. I have just moved a fake file around. I have checked, Lucas Arts does not own the exclusive rights to the filename StarWars720p.mkv. This would be a kin to trying to bust someone for dealing drugs when all they sold was flower or soap. Everyone walks; even if the buyer or seller really thought they were doing something illegal, they were, IN FACT, not. Please understand this is just an example, but valid none the less. Lucas Arts the the rights to the name Star Wars regardless of if it's a fake file or not |

| reply to plvick My first question that comes to mind is what are you sharing on P2P?
Documents created by you, open source software, programs you have written, shareware/freeware software or what?
If that is the case you're ok, if it is mp3's or movies not created by you as in did you film the movie or record the music not rip it off a CD or DVD then you got busted for theft and have no pot to piss in.
Did that about cover it? |

| reply to alexintexas said by alexintexas :however it maybe FCC rules but a "compromised system" such as port scanning, TWC and any other provider is going to lock that connection or kick your butt off that system UNTIL its resolved, a The FCC has no say over a compromised system relating to a computer that has been hacked. Now, if someone hacks your wireless router and makes it transmit at 200 times its authorized power limit, then they might get interested. |

Their stock price is at a 10-year low, I wonder why... Wow, are YOU uninformed: » finance.google.com/finance?clien···NYSE:TWCIts kinda hard to have a 10-year low when the company HAS NOT BEEN PUBLIC FOR 10 YEARS Time Warner Cable Inc. (Public, NYSE:TWC)
Right from your link.....I thought anyone on NYSE was a PUBLICLY traded company?
Edit : From TW page »ir.timewarnercable.com/faq.cfm?faqid=2
Time Warner Cable did not become a public company as a result of an underwritten initial public offering. On July 31, 2006, a subsidary of Time Warner Cable completed the acquisition of certain assets of Adelphia Communications Corporation and related companies ("Adelphia"), which were then in bankruptcy. Approximately 156 million shares of Time Warner Cable Class A common stock approximately 16 percent of the total were included in the amounts paid for the assets.
On February 13, 2007, Adelphia's Chapter 11 reorganization plan became effective and, under applicable securities law regulations and provisions of the U.S. bankruptcy code, Time Warner Cable became a public company subject to the requirements of the Securities Exchange Act of 1934, as amended. Under the terms of the reorganization plan, most of the shares of Time Warner Cable Class A common stock that Adelphia received for its assets have been distributed to Adelphia's creditors.

| reply to plvick So, nobody answered your questions directly because some of the details are unclear. Hope you don't mind if I ask a couple first, in order to give you a clear reply.
1. What P2P application are you using? 2. Do you have a way to throttle it in the application, or is it running as fast as it can? In other words, how much of your available bandwidth up and down is being used by the one application? One way you can answer that question is by running a speedtest while the P2P app is also running. The speedtest will give a fair ballpark value of what's free. 3. Is VoIP your only telecom dial out? 4. What happens to your connection when your P2P app is not running? Can you ping any address freely, or does that action still cause your disconnect? 5. When you experience your disconnect, what do you have to do to get it back? It sounds like you are experiencing a problem that is not permanent, but I may have misunderstood. Do you reboot the modem or what?
The above questions are for the hardware or technical aspect of your questions.
6. What kind of files do you download, and consequently upload, in the process? Not saying anything about legality or morality, just want to know. Linux distros, music, movies, what? In other words, why do they think you need a letter? I doubt it's because you're using the app, it's probably what you're using the app for. 7. Why do you think they are targeting you unfairly? This is sort of a different way to look at question 6.
Give me some feedback, and I'll have a better understanding of your questions. |

| reply to plvick Intent to commit a crime is still a crime.
You knew the name of the file, regurdless if it is fake or not it shows you Intended to download the file that you had no rights too.
This is the same way they catch Pedophiles...if I post a file named "4yo giving bj" Then you know what it is. Just like if i post a movie, with the title. Had it actually been the real file, then yes you would have broken the law, but this shows intent to break the law. Hence the crime.
Not saying I agree with it at all. |

Time warner cable has only been traded since Feb 2007 like your post indicated. My comment simply means what i wrote: The company has not been traded for 10 years, hence there cannot be a 10 year low. |

| reply to plvick Actualy your wrong, the act of dowloading a copywrited work, regardless of real or fak, still shows intent to defraud and infringe.
Just like in your example, if some buys fake crack thats realy soap, still shows intent.
I sugest you stop whatever actions your doing to prevent this. Also TWC has no libality for 3rd party VoIP services, as to the RR network its just data. If you dont want to lose ur phone live, get TWC voice services.
I still dont get why you post and then take offence when people give valid replies to your points, especially when your asking for illegal actions like uncaped lines and such. |
